I have been reading the I-485 AOS Instructions and I am a little confused regarding (K-2)children on our K-1.  

 

Do I fill out a seperate I-485 for the 8 year old child who has a K-2?  Or do I send in the I-485 with the $1140+$750+$85(biometrics fee).

 

I noted on the filing fees it is $1140 for the I-485 and $750 for children under 13 years old filing with an adult.

So it would be $1140+$750=$1890 total plus $85 for the biometrics fee.  For a grand total of $1975.

Hi! No need to file a separate application for your K2 child as long as you're filling together.

There are fields in the I-485 application form information about your child/ren (PART 6, pg.8).

Complete the information for your child and you're good to submit one single form for both of you.

You said you're child's age is 8 so... you don't need to pay for her biometrics.

So like your last statement... it will be $1140 + $750 + $85 together with I-485 form and the rest of the required documents.

I-485 Adjustment of Status

Each K-2 applicant will need their own form and supporting documentation. When compiling ours, I assumed that the 2 applications could be split from one another, especially as we no longer share the same surname. I included the following documentation:

I-864 - Affidavit of Support K-2's don't require their own separate I-864 with supporting documents (tax returns, etc). Make sure they are listed in section 9 of the K-1's I-864, and provide a photocopy of the K-1's I-864 with the K2's paperwork. You don't need to include copies of the supporting documents with the K-2's paperwork. You won't get an RFE if you do happen to provide a separate I-864 with supporting docs for the K-2. It's just not required.

I-765 - Employment Authorization Document This is one of the two documents that the SSA will request if you want to apply for a SSN for your K-2 adjustee. Under 14s may also apply for one, if you wish to ensure that you can get a SSN for your child before their GC is approved.

I-131 - Advanced Parole Works in exactly the same way as the principle applicant's AP.

It is still not clear to me even after reading the USIC website and the two responses.

 

Do I send a I-485 for my fiancee and a seperate I-485 for the child?

 

On Mom's I-485 we have the child listed.  It seems we only need to send the one form with the child listed to adjust both of them at one time.

I recently sent in two sets of applications one for K1 and for K2.  NCIS assigned numbers for all 6 applications to be worked.

 

Don't know if correct but that was what I did

 

Received last week biometrics appointments for both in two separate letters but same date and times
