How i can file Taxes without SSN..?

How can you both not have SSN? or you mean only your spouse don't have SSN, is she in another country? if she is then you file married separately and that does not require SSN or TIN.

Timeline

Assuming one of you has an SSN, which I'm thinking is the case, then you can file "Married filing Separately". Then you can enter "NRA" where your spouse's SSN is requested. Make sure your state will also accept NRA for tax purposes, as some states require an SSN or ITIN, even when filing separately. If your state requires it, then go ahead and keep reading because you'll need to do the ITIN application anyways.

 

If you want to claim any exemptions based on your spouse, or if you want to file jointly, then you must obtain an ITIN number for your spouse by filing a W7 with your federal return. From what I've read from other VJ'ers, some states may allow you to include a copy of the W7 application with a mailed-in state return, while other states will make you wait until the ITIN is issued, and then you can complete and mail in the state taxes. Check with your state and read all directions very carefully.

 

In both cases, you must paper-file your return, you cannot e-file.

One of us do have SSN. Since i am already here in US now we doing AOS. thanks for help.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
