This. Just reading the first post, almost anyone could believe that he came to the US to bring the OP and their child/children to the US. Not to mention anything he may have not told USCIS about, such as children, or anything like that on forms.

How can he applies for us to immigrate to Us ?the lawyer said we need newmarriage for us then apply but should he apply for us now or he better waits untill being a citizen ?what is the situation of our kids ?the lawyer scared me that our children may not be able to travel coz of time they were born while he was married to his wife or during their divorce period .Im tired of us being apart like this ;tired of being single married mother i just want them to be raised in a true family that is all not like i will die just to go to usa .i believe that god is great and whatever is meant to happen to me and my kids will happen no matter what .i hope to get advice from you that i can work on thx in advance .

1. On what basis would you have been coming to the US.

 

2. As others have said you are not legally marries, well not as far as the US is concerned.

 

3 He removed conditions, did he declare his children with you when he did so?

 

3. You want the children to travel, on what basis, as tourists? Do they have Passports, Visa?

 

4. The simplest solution would be for him to move to you, no messy issues.

 

5. I may have missed it, which Country are you in.

Unfortunately your husband has put himself and you in a very bad situation.  I'm not sure which country you are from but in Pakistan cases likes these have become an epidemic.  Your husband is going to have an extremely difficult time (if not impossible) bringing you to the USA and may not be staying long himself considering the laws he has broken while in USA.    The embassy is very well in tune to men traveling back and forth between USA and the home country impregnating a second wife for several years then "attempting" to file for her after divorcing the USC wife.   This is the very reason my husband and I have had to prove over and beyond that he is divorced from his ex wife.  The embassy drilled the facts above in my head over and over which sucked at the time (because I was not aware how often this happens) but it has since made me 100% more confident in my marriage and our relationship stronger.  

 

The best bet would be for your husband to move back to your country be with his family and raise his children.   I'm afraid it's the only sure-fire way you'll be able to have the "real" family you desire.   Although Polygamy may be your religious or cultural practice it's not legal in USA and if he wished to participate such practice he should not have done so attempting to become a USA citizen.

If you guys are married, your husband is a bigamist and the easiest way to live all together will be for him to return and live with you.

 

He might want to cancel his citizenship application to avoid further problems.

 

He should seek legal help from a lawyer - fines and/or jail time is possible if he's find guilty of bigamy.

I wouldn't get my hopes up for you to ever move to the US. Your husband will be coming back soon also and you won't have to worry about immigration issues anymore.

i think the odds of you moving to the US are slim to none, and i think the odds of him getting citizenship and being able to successfully petition you (or even stay here himself) are even slimmer.

and the issue isnt about the kids being able to travel... its about his bigamy and likely omission of the fact that he HAS children with you. those  two facts will be what gets him deported.

On the other hand, while not condoning the actions of the male, the OP went on to have a marriage knowing the male had a wife. His marriage having problems is not sufficient reason to justify marrying him in any form.

What does your husband say about moving to your home country to be with you and the kids?

That seems the best option considering the history, even if he ends up getting his N400 approved.

On the RoC form, this question is asked.......like others have mentioned, if this information was omitted, then your kids' father potentially lied on his application.

 

To dig a bit further, if he did leave that detail out, it could be that he may not have wanted questions raised since the children were not with his USC spouse. These are questions you need to ask him.

Just to add on to others' comments.....being from different cultures or religious practices does not mean that what you and your kids' father did was okay - cheating is cheating, no matter how you dress it up.

You knew he was married already but you still put yourself with him and had kids....not judging....just pointing the obvious.

He knew what he was doing each time he visited and left you pregnant....you possibly could not see that....again, not judging.

 

Each comment now would be moot as the situation already occurred and cannot be reversed. Coming to America is the least of your worries, what would you do if he decided to only visit you in your country and not file for you to come to live in the USA?

As human beings, we all make commitments when we think love is involved.....marriage....children.....financial co-mingling, etc.

Once the smoke clears, it is only then that we realize it was all a farce and infatuation that made us make the decisions we did.

You say you have a religious marriage, to confirm this religious marriage would NOT be considered a legal marriage as well in your country?

On his N400, your husband should have disclosed information regarding his family

look into getting a good immigration attorney if you want any chance of relocating your family to the US

If he obtained LPR status by virtue of marriage to a USC then he has to wait 5 years before he can petition a spouse anyway. By that time he will be eligible to file for citizenship - whether he is approved or not will be another matter.
