When can I mail out my I-751?

Hello everyone!

 

I am just about finished my I-751 and supporting documents and my GC expiration date is October 31st, 2018 - which means my 90 days to file would fall at August 2nd. Would I be ok to ship it on August 1st overnight? Or will they turn it away because it was shipped BEFORE the 90 days prior to my GC expiring?

Sent I-130 (via Canada Post): Feb 29, 2016

NOA1 hardcopy received: March 16, 2016

NOA2 approval text & email: June 9, 2016

Just wait one or two days and ship it when your window open. Why risking having your petition rejected over something stupid like sending a petition a day earlier? ;)

When calculating the 90 day period, it is not the expiration date that matters, it is the 'Resident Since' date that counts. So, use that, put your anniversary date here, and ship within the 90-day window.

 

Although the date they receive it is of most import, if you ship before your window opens, you will have to sign a date in the application that is before the window opens. They are not very dumb at USCIS.

[05/14, 2014]  - DAY 009  (day 0811) Received NOA1 (GC Extended for 1 year)

[01/14, 2016]  - DAY 620  (day 1421) 10-year GC in hand

[02/22, 2017]  - DAY 001  (day 1826) (N-400) Mailed package to Lewisville, TX, via USPS overnight

[01/10, 2018]  - DAY 323  (day 2149) (N-400) Naturalization Oath Ceremony (5 years, 10 months, 19 days)

[01/10, 2018]  - DAY 001  (day 2149) (US Passport) Applied for US Passport, regular processing

01/25, 2018]  - DAY 015  (day 2164) (US Passport) Passport in hand (5 years, 11 months, 3 days from start of Journey.)

[11/21, 2013] - Day 153 SSN and 10-year GC in hand

09/01, 2021]  - (day 3001) (US Passport) Passport in hand (8 years, 2 months, 18 days from start of Journey.)
