Hello all,

 

I got my green card through Diversity visa. I live in the us since 2015. Now I met a British citizen woman and I would like to Mary her in the US. How can I get her a green card without her leaving the US? Thank you.

As an LPR, you can petition for a spouse; but processing for this is about 2 some years. So unlikely she could stay in the US legally and would have to go back to finish the process.

 

Now, that being said she can visit and stay with you during the process through VWP or on a tourist visa; but not come to live here in the US.

Since you’re not yet a U.S. citizen she is not going to be classified as an immediate relative and will need to wait for a visa number prior to changing status after you petition for her. The wait is going to take around 2 years and she MUST be legally present at the time to be able to adjust status in the U.S. without leaving. This can be done if she’s here on a student or work visa but not on a short term visit such as the visa waiver program. If she has a short term visa she must leave and wait for her visa number to arrive years later, though as a British citizen she has a better chance to still visit temporarily and spend time with you as the process unfolds.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

what if we decide that she over stay here with me until I become a US citizen and apply for her. Is that possible? Is that going to eliminate her chances of getting a green card because she overstayed her VWP?

Yes it will. She can not adjust status if she has overstayed, and as soon as she leaves after an overstay she will incur a ban for 3 or more likely 10 years given the kind of overstay you’re talking about. Do it properly.

Did she already overstay her VWP? If so let her leave ASAP so she doesn't get a ban. Then start the i130 procedure and wait 2 years just like everyone else does. You're not special.

 

You must love her a lot if you're willing to have her deported and banned from US for years - which is a possibility if you decide to follow your plan. Not to mention she'll won't be allowed to work also. Or leave US.

I can't imagine why a husband would encourage his wife to break the law, especially one that carries such devastating repercussions (10-year-ban, potentially). 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

And what if you don't become a USC? That isn't a guarantee until after you've taken the oath. If you run into issues that delay that process, or at worst, prohibit it, what then? Your wife is deportable. This is a bad plan all around. Also, if your plan comes to light during the citizenship process you better believe that it will bring things to a grinding halt. Participating in immigration fraud is absolutely grounds to deny a citizenship application.

 

Treat her right, follow the process, have her use ESTA to visit properly (keyword visit), and wait.
