Hi,

Apologies if this has been asked before but I can't find and answer.

 

 

So according to the UK passport agency when married and name changed I have to obviously get a new passport but that may cancel any existing visas.

 

how does everything link up? If I cant update my passport til AOS granted then no flying internally either?

Do I just update my passport details on my AOS  application or do I try to get my new passport expedited before filing for AOS and if I have to get a new passport how does that affect any exisiting right to be in the US once married but AOS not filed yet?

 

just a little confused with everything I've been reading at the mo.

October 2017: Washington DC visit.

December 2017: Seminole OKC home visit and Amanda  met Chayne's kids and dad.

January 2018:  York England visit Chayne met Amanda's son.

April 2018: London/Paris/York visit we got engaged on April 6th!!

April 19th 2018: packet sent

April 23rd 2018: USPS say packet signed for.

April 25th 2018: Electronic NOA1 received 

April 26th 2018: Cheque Cashed

April 30th 2018: hard copy NOA1 received

June 2018: Seminole visit, Amanda met Chayne's  adult son

You can fly internally using your existing passport as an ID.

You don’t need to necessarily update your passport with the name change from US and AOS perspective. You can file for AOS with the name change with the current passport and the marriage certificate (provided it’s just the surname change).

If you get a new passport, it doesn’t affect your right to be in the US as long as you have met the visa conditions like marrying within the 90 days of entering the US. Your K1 visa is no longer useful once you entered US anyway.

Apply for AOS in your married name.

Reserve international tickets in the passport name.

Consider waiting until you have a US driver license for photo ID before mailing your passport to the UK for the new passport process.

Thanks @arken what about official documents if my passport is in the wrong name like bank accounts, driving licence etc? Would I have to provide a copy of my marriage certificate every time?

Driving is a state based thing so depends on Oklahoma. BUT for most states, the driver license office is going to require that you have your work authorization (EAD) or a greencard before you can have a license. So you apply for AOS/EAD/AP in your married name. Your EAD/AP comes in Married name.  USCIS database changes you from "K1 Maiden name" to "EAD married name" upon approval.

 

When you apply for a SSN right after entry, you have to apply in the maiden name (even if already married) because they have to use the name USCIS has n their database for you. When you get your driver license after EAD or greencard, you apply in married name and they will find you in the USCIS database under the married name. You shouldn't need to prove a name change to the DMV as long as they find that married name in the USCIS database.

First, find out how things work back home.

 

You are not obligated to change the passport name, if so, I'm pretty sure that you'll have to change your name in almost everything back home (bank accounts etc). As for the US, once you have your state ID ans SS card and future Green Card with new name, you will not have to use passport anymore as a valid ID (unless for travel purposes of course) in which case you'll have the document that supports your new name. I think it's easier not to change it on the passport but it will depend of your preferences and home country requirements.

Hey @AmandaandChayne, I was just wondering if you figured this out? I find myself in a similar situation as I need to have my marriage entered in my country's records but then I have to have my passport renewed within three months! I wonder if it can possibly affect my pending AOS application where I used my current passport info?
