Significance of Letter written by ex wife to uscis

Hi Vj people, 

 

Does anybody in the group had the experience of bitter divorce with full revengeful feelings?

As i had this experience and i highly suspect my ex wife has wriiten bad letter to uscis . So it was making me anxious and was thinking how badly it can affect my application?

Kindly share your experience if anyone has gone through similar condition.

Unless she has proofs of you commiting immigration fraud you have nothing to worry about. If she does and submit those to USCIS then you'll be facing issues.

Thanks for your input . Right! Just by saying  (irrespective of the fact that she is US citizen ) uscis people wont believe the false charges until she has proof, which i doubt . As ours was legitimate marriage . she was the one who brought me into this country , then tortured me mentally , wanted divorce at first place and now she wants me to get deported.  Ridiculous people!!

It can affect it.

 

It certainly did with me - and I received a denial because of it.

This is despite a) the allegation(s) being completely false and b) I was never given an opportunity at any point - including at interview - to refute any allegations, which I could do with evidence, as they are false.

still do not know exactly what was written, or said, only the specific point that USCIS cited as reason for denial.

 

So yeah, it can affect it negatively.

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

Looking at your signature it looks like way more went wrong in your case than just that. I'd say showing up at your third scheduled interview with a finalized divorce waiver. I could see them say your file wasn't done correctly because you did not include the divorce in your file until the day you showed up for your interview. Normally people would send in the waiver, even if the divorce wasn't finalized, have that added to their case and present the final decree later.

Note though, the only reason I'm scrutinizing this is because you're the first person on VJ that I've seen that believes an ex-spouses letter denied you.

Massive and incorrect assumptions there based on the very limited info in my signature.

 

I requested a switch to a waiver at the terminated interview. I didn’t receive notification of the second scheduled one, not could they tell me when it was sent.

 

 

 The divorce was finalised shortly before the third interview, at which they asked me to confirm that I had requested a switch to a waiver, and requested a copy of the final decree which I provided.

 

The single reason for denial was clearly stated in the letter and was very specific that it was directly due to a false allegation made by my ex spouse some 18 months prior - despite having asked USCIS on multiple occasions if the reason for delay was due to some form of contact made by my ex spouse or if they made contact. I was point blank lied to on numerous ocassions (including in the interview) and told that USCIS had not been contacted by my spouse at all.

 

When this ordeal is finally over there will be a (very) long post detailing everything, but for now that will have to suffice.

So out of pure curiosity, what do you think your chances are at getting it approved this time around?

Everything they use to deny applications is kept on your record so the next interviewer and adjudicators can see all of it. Anything tied to your case is kept for future use and to have on file for you. I'm guessing that when you sent in the next I-751 that you included proof that the false allegations were indeed false?

And yes, a post going over everything would be interesting, again as I've seen you're the only one who has been denied based off what an ex-spouse has told USCIS. 90% of I-751 cases are approved because it's honestly kind of hard to deny them, even people with little evidence still show enough to get passed through.

It will get done eventually. I’ve filed my N-400, so just wish they would hurry up and get around to it.

No, I didn’t include evidence refuting the allegation, as I still haven’t been given specific details or the entirety of it, despite that being contrary to USCIS own policy. When it is all done I will file a FOIA request and hopefully get the full story.

 

The denial was specifically to do with the joint filing of it originally, and the reason cited was that it was therefore not filed correctly due to this statement by my ex spouse. 

Pretty ridiculous given it was switched to a waiver negating the joint aspect of it entirely and also that you can file with a waiver at any time, but it is what it is. 

 

I refiled an entirely fresh I-751, with a waiver request right off the bat, the divorce decree, and a few pieces of additional evidence I didn’t originally submit, and a cover letter. It was less uncertain than a request to re-open and more or less the same cost, so the easiest path at that time.

There was no issue with the evidence in the original ( I have still never received any RFE), and well aware that the new filing will go into my A# with the denied one and that is viewed and referenced during adjudication.

An angry ex shouldn't have any impact on the process unless they can show verifiable evidence that the marriage was entered into for fraudulent purposes.

In 99.9% of the cases (anecdotal...not a real statistic!) that is the case. Of coarse there are exceptions to the rule...those who fall in the cracks of fair adjudication.

In the end, it will work out if you have/had a bona fide marriage., Some just go through more hurdles than others to get there.

Look, you need to pony up the shekels and get a lawyer when dealing with anything regarding the USCIS, if you suspect this problem. The reason being that they are low level, low-agency government workers and it isn't worth their trouble to hassle you or exercise malicious judgment, if they suspect that they'll come under scrutiny because you have a $350/hour attorney watching their behavior during interviews/reading their notices. Why would you want to make your life difficult if you're some 100 IQ, 10am-4pm paper shuffler in some random town in Vermont?

Having a good immigration attorney is never bad advice, although they can only help you present your case beforehand, inform you about the process, file appeals after a refusal or NOID, etc. They won't impact the IO's decision in any way, except by helping prepare a strong case beforehand.

Does filing FOIA bring out information related to any false allegations/ letter written by ex (if any) ? As i have filed  FOIA recently along with waiver as advised by the lawyer .

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
