How I can revalidate my fiancee K1 visa?

My fiancée came to USA with a K1 visa on 06/18/2018, we married on 07/09/2018.  However, we got into an argument and she left USA without applying a travel document, green card or social security number.  Now, we reconciled and she wants to come back to USA and be with me, her k1 visa has a expiration date of 10/03/2018, and today is 07/29/2018.  Is there a way I can revalidate her K1 visa so she can come back to USA?  What is the process?

Only thing you can do is apply for spouse visa. Say hello to 12 to 14 months of waiting to be approved. 

 

K1 was valid for 1 entry and can't be used anymore. 

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

If you hadn't married yet, there was a chance to get the K-1 re-issued (with an expiration of the 90 days from first POE). However, since you married, you can't get a new K-1 (nor would you be able to use it since you are not a fiance anymore).

The K1 was issued for your fiance....that is no longer the case as you both are now married. K1 will no longer play a role in your visa journey.

As others have suggested, now you apply for the CR1 visa.....

 

Try working things out the next time around and not be so hasty to run off (not you...but you know). Communication is key in any relationship.

Nope. Can’t do it. K1 is for a single use. She already used it and it’s now void. If you’re not divorced you can file CR1 which takes 10-16 months or if you’re divorced you can file for another K1 which will take 10-12 months. There is no cutting in line for you. You will start all over whatever route you choose.

As the other posters said, your fiance;s visa could be re-validated with good reasons given, if withing 90 days of POE but since now you have married, this route is dead.

07/27/17 - K1 packet sent at the end of day.

07/31/17 - NOA1

03/22/18 - NOA2

08/28/18 - expected date for medical completion - Sputum test was needed

09/22/18 - anticipated interview date

Well, instead of giving you more bad news as it looks like you have had enough. The good thing is if she comes in on the CR1 spousal visa she instantly gets her green card ( About 3 weeks or so after entry) she will be able to work right away, and you won't have to mess with removal of conditions. So, at least there's that. Ohh! and no AOS either!

 

I think I should throw in here in order to avoid removal of conditions I believe you have to be married for 2 years, but by the time she enters on the spousal visa you may be close to the 2 year mark, and she will get the 10 year Green Card. so if you go this route you may want to tough it out if you can hit the 2 year mark before entry and save a good 800 dollars on ROC.

Well since y'all are married, you take the CR-1 spouse visa route. The process may take up to 14 months.

I feel sorry for you that now you have to start all over again with a different route. I hope your now spouse understands that immigration has rules we need to follow. Now you have to be separated for God knows how long and of course you will have to pay a new fees again. I wish you good luck in the new path.
