My fiancé (London) and I are currently preparing our I-129F and other required forms for the K1 process. We're aware that the I-129F expires on August the 31st of this year, so our question is: if we send the packet off before then, and then they ask for an RFE after August 31st, would that mean we have to re-apply and start again with a new, updated packet? Or would we be fine to just give them the evidence needed (hoping it doesn't come to that anyway, but it's a concerning thought).

 

Also if we do send it mid-August, is there a likely risk that if it gets there after or just before the 31st of August that they won't even process it?

Check and see if you can find a newer edition of the I-129F.  I would think that the new one would be out prior to the expiration date.  "IF" you file before, and "IF" they receive it and you get an NOA date prior to expiration ,  they would accept it, since it "is" the valid date.  However, It can usually be 2 weeks between the receive date and the NOA1 date.  Cutting it close!  If you think you won't have it ready by 15th, then just wait a couple weeks.  That will also give you a "no rush"  time to put everything together properly.  The RFE is a request for "more" evidence, and does not negate the application, however, again, the law is changing where they don't need to request an RFE and just negate the whole application if they think you omitted things on purpose just to delay your application.

Hi. You shouldn't be worried about it. If you send the right form in the right time you won't have any problem with USCIS while the proccess is running on. On the other hand, if you send the form in September you are taking a big risk. Sometimes the expiration time is extended for the forms in the USCIS website but they put that on there while they update the website. Success!

If you are referring to the date in the top right corner of the form, under OMB xxx, the date given there is an internal agency date and does not refer to the last date that applicants can submit the form.

 

Always make sure you get the most recent.. ie current form... by accessing the Forms section of the USCIS website... this will be the form to use, no matter what the OMB date .

On this webpage also look at the Edition date  dropdown in the center of the page.. this is the EDITION date that the form was introduced and it states that no older edition dated forms can be used.. ie this is the current form

 

The edition date is in the lower left corner of each page.

 As stated above the OMB date is a date for internal review and does not mean the form is expiring. All government forms are reviewed for their appropriateness and allow a certain period of time to receive public comments. This current form has comments varying from formal multipage statements to a  quick comment by an individual.

Sometimes the forms are modified and sometimes end up exactly the same.  Either way the form will get a new OMB date reflecting when the next review is due.
