Hello Guys just a a question. I wanna help my friend who just came here this year under K1 visa. I dont know what to advise. So she came here April, got married May, i am one of her witness. Lol. Then she applied SSN end of May, then she received her SSN 2nd week of June. They applied her AOS, employment authorization and travel parole all together, i also help her to organize the paper works on June 9. Then she said she received the receipy or the Notice of Action in all of those June 15. Then she received another letter i think last week of June for her biometrics on July 9. All done. Just waiting for Greencard, EAD and Travel parole. But then one of her friend referred her to their job. Since she has the ssn already but it was stated there valid to work only with DHS authorization, she is still waiting for her EAD but July 10 she already accepted the job and started working until now. 

 

I told her why she accepted the job.. she said she wants to work and save. Now I dont know if she needs to stay or resign in her job. I asked her does her employer asked anything from her. She said the SSN and if she is legal to work. She said her EAD is on process. She just waiting for it. Since she has SSN the employer accepted her and said just provide the EAD once you have it. 

 

Does her AOS application will be affected? Does she needs to resign? What does she needs to do? Her friend who referred her said its ok. Now she is asking me. I dont know what to advise. 

 

Can anyone give me an advise what to tell her? Thanks.

You need to tell her she is working illegally and that it could end really badly both for her and the company she is working for.

Unauthorized work is not a bar to AOS as the spouse of a USC.

At the same time, she is working without authorization. Nobody on VJ can condone violating status / breaking the law.

The employer is the one who is most likely to get in trouble, if caught. They should have made her fill out an I-9 to verify her work eligibility (or e-Verify for larger employers).
