Infopass beneficial in the situation

A friend of mine has applied for a CR1 visa. She recently received an RFE that neither she nor I can figure out. She is a private person and doesn’t want me to discuss it publicly.

She is thinking of scheduling an infopass to try to get more information and clarification regarding the RFE and exactly what is needed to satisfy the RFE.

 I am unfamiliar with infopass and the role they could play in helping in this situation. Do you guys think an infopass would be beneficial?

"You submitted a mixed marriage certificate from the notary, however your marriage document was not listed as an acceptable civil document from the Kingdom of Morocco for visa purposes. Please see the acceptable civil documents from the link below: 

https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/Morocco.html

 

Submit a photocopy of the original marriage certificate for the marriage of XXX and XXX. US Dept of State had indicated that marriage certificates are available from the Kingdom of Morocco, they are called Aakd Zawaj (Acte de Marriage) with alternate documents which are Deed of Confirmation of Marriage and Deed of Verification of a Judgement of Confirmation of Marriage. The marriage certificate must be issued by an appropriate civil authority. In order for the marriage to be considered valid for immigration purposes, it must have been legally valid in the location where the marriage took place. The document must include the date of registration and signature of the registrar. "

 

The recipient sent the exact same marriage certificate as many others who did not receive RFEs, and the court says it is official.

@geowrian, any ideas?  Maybe resubmit the same certificate with a letter explaining what the court said?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Gotcha, thanks! So yeah, the RFE says it was an incorrect MC provided.

Unfortunately, this is a Morocco-specific document so I don't have any input on what they do or don't accept as the MC there, sorry. If the document provided is the correct one, then providing it again + a letter explaining it + a copy of the document requirements form the link you present would typically be the way to go. But one must be sure that the document provided is actually the one they are looking for, which is beyond my area of familiarity.

Exactly what they are looking for will be explained at the link given.  Get the document they describe and send it in before the time runs out or the petition will be denied.

Therein lies the problem.....

When you follow the link it tells you that it must be an “acte de mariage/aakd Zawaj”. My friends marriage certificate says, in Arabic, that it is a “marriage contract”.  If the documents the RFE is requesting are actually the documents she sent....

Could it possibly be a translation issue? And if it is translated again and you send the same marriage certificate with a different translation does that look suspicious?

Which court?  The instructions include exactly which document and from which court.  If it isn't the correct document, it doesn't matter if others were approved.  The RFE is very specific in terms of what WAS submitted, and the link describes what appears to be a very DIFFERENT document.   She needs to secure and submit the document described at the link USCIS gave you.

Agreed - the documents necessary (and how to obtain them) are listed in that link. As for the specifics (i.e. what an acte de mariage/aakd Zawaj is or how it differs from the requested document, if at all), I have no clue. If the submitted document is not exactly what was stated and issued by the appropriate civil authority (the RFE says it was from the notary...?), then the correct document needs to be obtained using the instructions in the link.

Thank you for your responses. But the link states that you will have to contact the Adul to get a copy of the certificate......so if in contacting the Adul (the same Adul where they were married).....they send her a copy of exactly what she sent as a “certificate of marriage” then what other recourse does she have?

Hypothetical.  She hasn't done that yet.  If they send the same thing, she should document the exact request and the response.
