To Affidavit Support or not, that is the question?

Timeline

Hello everyone, 

 

I think we are all set; Interview on 8/8/18, St Luke's the 2 days before and CFO the day after. ( flight & hotel is booked)

DS-160 is done and I think everything else is, also the Visa has landed in Manila from USA and is "Ready".

 

One last thing is I'm reading about the affidavit of support and a few people said that we need it but it does not say we do on the check list from the Manila Consult.

Good idea to just do one in case? what form would I use, we are a K1 Couple .

Financials are rarely ask for during your interview but we have seen some who have been asked. To avoid a RFE send the needed documents.

 

The checklist says - FINANCIAL DOCUMENTS. Applicants must provide evidence that they will not become public charge in the U.S. You may visit the Department of State website for the proper Affidavit of Support information.

Actually the checklist does include the I-134.     And as Greenbaum states it is rarely asked for (since 2014) at the interview.     Just the same you don't want a 221g, for missing documents, at the interview  .. be prepared.

Hi im the beneficiary and i had my interview last july 25. I initially thought i dont really need the affidavit of support or the W2s or tax transcripts. Most of the people here suggests to have these things ready just in case the consul will asked for it. So i followed their advice. On the day of my interview they never asked for any of these docs not even the prof of relationship. The consul focusses his questions about me and how well i know my fiance so as the genuinity of our relationship. But i know someone who was asked during the pre screening of her interview last july 12. This is when a Filipino consul will asked questions and gather your documents. It actually depends on the consul who will handle the interview so i would suggest to get these docs ready just in case so it wont delay your process.. I don't really understand why they don't ask for them at the interview. It would really cut down on problems after arrival. It is very easy for a western man to give a woman the illusion that he has money when he is in the Philippines. There are a lot of "borderline" men who go there. Just my impression....

It's on the checklist .. just have it ready, no different than pictures and relationship evidence - which isn't asked for every time either.     

 

No brain'er - follow the checklist and like a Boy Scout     BE PREPARED.

 

Really doesn't matter after that.

I see your point. Haven't a clue why they are not asking as there are many who I see thru out the threads who are worried or they need a co-sponsor. It boggles the mind but in the end, it's a means to make someone happy. So I really don't have opinion either way. :D

The I-134 is a non binding contract, thus it is null and void. I have seen paperwork from USCIS stating this.

 

We have had a few CO tell people that the I-134 was never really ever required in the first place.

 

Why the US Embassy in Manila has decided to not ask or enforce financials or I-134 is a head scratcher to me. 

 

 

Just when you think you have TDS eradicate,  a new case shows up.

You are correct on the non-binding with the I-134.  It is a form designed with other intent, not the K-1.

 

As for required or not .. if the DoS decides that it is required, binding or not, and the CO asks for it and you don't provide it .. no visa.     But then in the world of visas .... the embassy is god.

That is a valid point but the fact is you only need to make $20,000 gross to meet the requirement for 2 people.  That is VERY low and would be extremely difficult to live on $1600 a month GROSS!  I'm sure it is possible but that is a tough way to start any relationship.

 

Filipinos are very good at budgeting so maybe the US realizes that $1600 a month in the hands of a filipino is worth much more than it sounds.  My asawa is incredible with money and they still live very comfortably.  I think maybe they realize how good the filipino is at stretching the dollar.  

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.
