Then that’s the reason.  He must be enter before or with you and he was not considered as domiciles at the time  of the interview  ... clearly established ruling consistent with the issuance of the visa

Im sorry.. i mean is that.. he is domiciled in US beacuse he's living and working there for a long period of years.. he actually left US only for 1-2 months vacation
