Hi! My wife and I got married  in 2014. My AOS got approved in 1/2016. I filed ROC in 10/2017 and have been waiting so far.

 

We bought a house recently and wonder if it would help to file some document of the property as additional evidence. My initial I-751 filing included four years of our rental contracts up to the filing date.

 

Another reason that I have been thinking about filing additional evidence is that I read that you should file the complete tax return, including W-2, etc. But I don't remember if I filed the whole return or just the 1040. Yeah, I know I am stupid and want to kick myself on that. So if I file some more evidence I could include the full tax returns for the past few years.

 

So what's the best thing to do for now? Just wait? Or shall I submit some new evidence right now to USCIS? Will they even accept new evidence during the waiting period?

They will accept new evidence, just have a copy of the NOA with it so they can put it with the right file.


Personally I would wait for an RFE or anything. I also forgot about the W-2's, but in reality they don't really care about the complete tax returns, just proof that the taxes were filled jointly, showing bona fide marriage. which they can see from the 1040.

We filed in May of THIS year, and even though we had plenty of evidence (two new car loans, leases, being each others beneficiary on 401K, life insurance, AND investments, car insurances, bills, school registration showing him as a contact to pick up my daughter, two years worth of joint bank statements, etc) I was still able to figure out more things I could have sent, like copies of our drivers license showing the same address, the adoption of our cat, him being a point of contact for my daughters therapists, anything addressed to the both of us, text logs showing we clearly talk -all- the time, and who knows what I'll come up with in the next two years LOL.

Thanks, Ash.1101! I was also leaning towards waiting for an RFE too until I saw this in the news https://www.uscis.gov/news/news-releases/uscis-updates-policy-guidance-certain-requests-evidence-and-notices-intent-deny

 

I have to say that I was a little panicked and was planning to file all other evidence I can gather asap. But after reading it carefully I understand that the new policy will only apply to new cases filed after 9/11/18.

Yep! And we’re not all entirely sure if this is for visa applications only or all applications.

 

we’re also not also sure what constitutes as meeting the requirement. Do you meet the requirement simply by showing two years of joint tax returns? Is everything else extra?

 

theres still a lot of what ifs on this one.
