Dear All, thank you for discussions. The DV lottery visa was rejected under 221 a 2, (A)(2) - drug offense, while the winner and her child were told that the embassy ran out of visa numbers, and by Sep 30, they will be notified if they get the visa or not. Considering that their interview was May 3, and many people were approved after that date, I assume that this rejection had an impact on their case as well. And one more question, in case the winner gets a visa, are there any chances of bringing the husband with this rejection to the US? Once again thanks a lot

Sorry to hear that one of the negative suspicions was right. And it appears that yes the rejection had an impact because the CO clearly decided to delay all issuance waiting for AP - that’s why they lost their visa numbers (as explained in earlier posts when AP crosses a month end). An unfortunate outcome, albeit a silver lining in that it keeps the family together. If the winner is able to get a visa allocated off the waitlist in September , it may be a very long and uncertain process to get the husband over. The US is very strict on drug offenses - this rejection would  have been the same for any immigrant visa. There may be a waiver available, but the wife would need to get legal advice ...basically she would apply for him, it would be an approx 2 year wait for spouse of LPR, he would be rejected at interview,he would find out at that interview if a waiver is available for the rejection, and then if he can apply for a waiver probably another year or so and $$$ of legal fees to try a successful waiver.

Thanks for the reply. Nevertheless, they will need to wait by Sep 30 to know if the visas will be granted or no!
