ME & MY HUSBAND WENT TO APPLY FOR HIS SSN HERE IN ILLINOIS BUT THE LADY THAT WORKS IN SSN OFFICE SAID WE HAVE TO WAIT FOR HIS EAD(EMPLOYMENT AUTHORIZATION) DUE BECAUSE HIS VISA IS FIANCEE AND THEY CANNOT JUST DISPENSE ANY SSN NUMBER TO US.. SO WE HAVE TO WAIT FOR IT TIL HE GET HIS EAD CARD NOW WE ARE IN THE PROCESS OF AOS/EAD.. PLEASE GIVE ME SOME FEED BACK ON WHAT TO DO OR IS THIS REALLY TRUE?

This exact same thing happened to me, but in Florida... we went back and got a different lady, she KNEW what she was doing... she took the application there and then.

On the SS website they have a policy that says a K1 visa holder is allowed a SS without a EAD, I dont have the link to hand... but I am sure someone else will be able to give you this... I know though that some people showed this to there local ss office and it mad no difference..... Good Luck!!! :thumbs:

I went to the SSA office a week after our marriage but a month after arriving in the US. U can get a SSN without the EAD, the card will just say "not valid for work w/o DHS authorization'. Just bring your marriage certificate and your husband's passport.

Like joan/roger, my husband received his SSN only one week after being in the U.S. He had no problems - his SS card says he can't work.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

It is not true. A K1 is eligible to apply for a SS card during the first 76 days after their entry. Try another SSA office.

Also search VJ for posts on this subject by I QUIT (aka MDYoung).

I CHECK OUT THE WEBSITE WHERE THE SOCIAL SECURITY INFO ABOUT K1 GETTING A SSN NUMBER IT'S STATES THE IMMIGRATION STATUS AND THEY MUST HAVE A 1-94 WE GOT THAT BUT IT JUST SAYS K1 VISA... SO I GUESS ILL TRY OUR LUCK THIS COMING MONDAY.. THANKS FOR THE REPLYS

Ask for the office manager and tell him or her to read RM 00203.500 C1. Now your status will still need to be verified, but they should accept the application.
