I wouldn't be pushy if they were honest with us. I think they took too many clents cases and cannot keep up with workload.

I think you should just dump them once you have confirmed they actually sent it and receive your case number.

That's my plan. I'm just wondering , once I get my NOA's, can I contact USCIS and took the attorney off my case?

since they are old posts, i will just suggest you to call USCIS to check with them the correct method.

Absolutely. I don't have experience on this subject as I never had a  lawyer. But if you have given your lawyer permission and wrote their name and contact info on the AOS papers, I am assuming you should let USCIS know you're not with them anymore.

Then they probably dropped the ball and don't want to admit that they messed up. Not exactly great ethics, but at least it's not a scam.

Yes. You can send a letter requesting that they remove the attorney from your case.

"Send us a letter saying you want to withdraw your legal representative and intend to continue your case without any legal representation. If you do so, USCIS will communicate only with you."

I paid my attorney via a retainer agreement and write my own check for my application fees. Ask for proof that the check has been cashed. The bank statement will show when the check is cashed.

Your attorney can at least provide you with a tracking number so it can calm your nerves.

If you are paying an attorney (which you really don't need anyways!) for services to be performed, he/she is being PAID to perform a service on your behalf. If they are refusing to provide you with ANY details regarding documents you entrusted in their care, then you need to up the ante and let them know that you will write a formal complaint to the American Immigration Lawyers Association highlighting their refusal to provide attorney-client disclosure which was silently agreed to when you placed money in his/her hands for assistance with immigration services. This is your future they are messing with!

When USCIS centers receive packages/case files, they are mandated to upload each single document on their computers and generate a case number for the received petition. This is when they see what is needed, if critical documents were missing from the package, etc. That is the point when they would provide an NOA with any applicable RFEs.

 

Get the tracking information from your shyster attorney or threaten them with being disbarred from practicing immigration law :bonk:

I tired to call them now, no response. I sent them email, nothing

I will go tomorrow and will  try get all the papers back. And money that I paid. I cannot believe that it happened to me.

I applied for my husband's citizenship and it was a smooth process. I would fill out AOS  myself but had some problems with affidavit of support so decided to use ,,professionals"

This would be my action, no threatening. Just proceed with the complaint. These people should not be allowed to practice law at all.

I don't care how reputable they are, if they are too busy already, they should decline working on your case instead of doing it half-###.

I called my attorney back and they keep telling me to relax,that everything is ok but won't give me the specific date when the docs were sent  or tracking number. I read through the comments prior to responding.  Our AOS took exactly 15 days from mail to NOA date.  Granted some are quicker, some are not, but a month is a month.  FIRST off, try to be calm and polite and not yell and scream at the lawyers office, they can and will just call the cops and have you both arrested.  Ask them "has THERE check been cashed yet.?"  They should be able to look easily enough.  They should have ALWAYS gotten a tracking number, and if they say "We have it and you can not see it", is a lie.  If there are no results in a week, I would call and report the agency to your state Attorney General, and also Perhaps call a state congressman about your complaint.  And if all else fails, refile withOUT a "lawyer". YOU can do it yourself, I did and thousands other before me.  Visajourney has been a wonderful help from people who has done that, been there sort of thing.   Then after all is said and done, file small claims for 100 percent of your money back from the "lawyer".   Give it another week though.  the gov is pretty busy!  OH, and ask them "how it was sent"?  UPS,. Priority Mail, FedEx.  could be a clue.  A company normally will use the same carrier for all their mailings and business.
