Hey @sandranj

I raised him from birth.  He started acting up around his teenage years and at first I thought you know it was a phase. But then as he got older he became very violent, when he would get angry he would throw stuff around and he would scream at me and call me names and he yells at me in from of my daughter, his sister. He pushed me once when he was drunk and punched holes on the walls of our home. He killed my dog out of anger at me for requesting a divorce from my violent husband, his father. Theres so much more... thank you for your help.

I have a Question on the new Notice to Appear (NTA) policy.

1.  Does it mean if your i-360 is denied you are automatically placed in removal proceeding without being given  a chance to appeal?.

2. When you do appear in court, can you tell the judge you plan to appeal or have already appealed?.

The last form I-94 that appears on the Web corresponds to an entry prior to the last entry. There is a way to ask USCIS for the last I-94 but that process (Form I-102) takes 4.5 months.
Question:
1. Can I send my I-485 without sending I-94, just attaching a copy of the visa and the entry stamp without fear of being denied?

My question regarding this new norm is: does it affect cases that were denied in the past or will it only affect cases that are denied from now on?

Send the I-94 that you are able to get online (even if it does not seem up to date). Then also send a copy of your visa/entry stamp from your last entry. 

Then, send all that to VSC.  

Then go ahead and send the application for I-102. You can then always bring the updated one to the AOS interview.

Hello!

I sent my documents on October 2017. Received a RFE by the end of January 2018(for entering in the marriage with good faith and also good moral), they received my responde in April 2018.

 

I got my EAD in February 2018 (please note that I got my EAD before answer a pending RFE, was said here that I would not receive it before I answer it).

I never receive a Prima Facie letter.

 

I know I'm supposed to wait a long time now, but how long it might take? 

 

Also, what means receiving the RFE for good faith marriage and good character 3-4 months after sent the documents? 

 

Can I receive another RFE again about good faith marriage? (I respond the first RFE with very detailed letter about our courtship and everything like Sandra says already)

My phycologist was not aware how to make the evaluation so he reffered me  to other phycologist and attended 4 session with him.  But my primary phycologist I attended 14 session in last 1 year. 

So my question is do I send evaluation and the individual session report or the evaluation is enough.

The timeline of your EAD is not connected to I-360 or Prima Facie. I-765 under category c9 is only dependent on a pending I-485. 

 

What you received was an initial request for evidence. RFE’s are being sent either right after VSC receives your petition and notices that certain documents are missing or they are sent once someone is adjudicating your case (currently around 16-20 months after receiving I-360). So there is always a possibility that you could get another RFE if they think something is missing. 

 

If you did not receive Prima Facie, no worries. Some receive it, some don’t. You can always send VSC a letter requesting Prima Facie if you need it to receive public benefits.

@Behuman this is what Sandra recommends for the psychological evaluation. Have at least a confirmation from the psychologist that you attended 14 sessions with over what time frame you saw him and why. And then have him write as much of what Sandra describes above as possible. Then of course also submit the psychological evaluation from your new psychologist.

When I received my RFE it was never said that it was a request of INITIAlL evidence, that's why I was confuse. it was saying only "Request for Evidence", even on the website. Does it change something? Because I thought it was on the RFE's name the initial...

@Poupis They don’t always call it an initial RFE. From your timeline that is still what it kind of is. Unfortunately you will have to wait until at least 16 months from your I-360 receipt date to get a decision. It makes it easier though that they are asking for evidence now already because if you submitted everything to their satisfaction, then they will just approve you, which is quicker than receiving an RFE after 16 months and then having to answer it.

Therapy sessions for 1 hour are between 75-200$. That on top of lawyer fees plus other fees is turning out to be quiet expensive for someone who does not even have permission to work in the USA.  Is there other solutions when it comes to therapy. Is it mandatory?

In my case I was not able to afford psychologist, so I had sessions with ywca, in my area, I was given two councillors, one for domestic abuse and one for sexual abuse, I have been with them for the whole of one and a half years,

 

Iwillsurve do councillors report ok or I must get psychological report?
