It says it is effective from Sept 11th and applicable to applications filled after Sept 11th, I think cases with receipt date of Sept 11th should be fine, certainly will affect cases with receipt date of Sept 12th

Receipt notice usually take up to 3weeks, may be your lawyer has not received it yet but you should ask you lawyer to confirm they have not received it.

Don't stress, just think if you may obtain anything additional just as back up ; like ur birth certificate (city id, medical, job, library, school or bank card) if none is available then just take the expired passport since you're out of options and don't point it out, hopefully all will go well anyway. Best of luck.

Try to ask your lawyer if they received anything. My lawyer didn’t inform me about the receipts til this morning.

Sorry, I did not ask the question correctly:
Can you please tell me the date you sent your package to USCIS, the date it was received by Fedex or UPS, and the date that appears on the receipt of the form, please.
It's for me to have an idea about my case, thank you ..

Im sorry, I was just told it was sent on the 7th and I didn’t get the tracking number from my lawyer which she promised to send me but didn’t. I’ll let you know as soon as i get the receipt from Fedex from my lawyer but I hope you get your receipt notice soon.

Hey I’m in vawa case since  January 2018

im outside of Usa bc before I start with this cases I travel with my advance parole to my country and my wife stop our process then in the airport the officer don’t let me in and Deportation from US back to my country now I waiting to my vawa approval 

my question is I need to get divorce from my wife and I don’t have any way to contact with her she didn’t answer to her phone she disappeared 

can I back to Usa with vawa recipe in the immigration in the airport them let me in to finish my process and to get divorce bc for divorce one of us me or my wife need to be personal in the state to get divorce and my wife is not an a option???

 

please help!

You cannot use a VAWA receipt to re-enter the USA, you must have an advance parole based on a currently  pending i-485.

You mentioned above that your wife stopped the process and you were turned away at the airport, this may be an indication that she withdrew the petition and possibly the i-485 is denied, but you need to confirm this information.

In this case if your wife is a USA citizen you have to apply for a new i-485, EAD/AP but since you are outside USA you may want to consult an attorney regarding your return they will advise you whether you can be paroled into the country or must wait until the VAWA is approved. You may want to ask @sandranj she said she helped several people outside the USA and I believe she may be able to guide you in the right direction. Good luck.

If you have been denied entry into the US, you will need a waiver in order to qualify for immigration. 

You will have to wait for your I-360 to be approved until you can do anything else. 

You cannot file I-485/Adjustment of Status because you are not in the US, so you have no base to adjust status from. 

I highly suggest getting an immigration attorney for your case. 

You should be able to file for divorce from your wife in your home country (or wherever you live right now). It will take longer but it is possible. You should consult with your local court. If you are not in contact with your wife, you will most likely need to prove that you don’t know her whereabouts and that you have tried everything in your power to find her. But again, every country has different laws, so it is best to consult with your local family law court.

Go ahead and contact your Embassy or Consulate in the US. No passport should take 2 years. I didn’t have a current passport at the time of the biometrics, but I applied for one now.

On September 7th, I sent a package to Vermont and it was signed as received by FedEx on September 10, the package included the following:
1. Answer RFE of the Vawa case
2. Form I-485
3. Form I-765
Although I still do not have the receipts for I-485 or I-765, but I received an email a few days ago where it says that the USCIS received my response from the RFE (Vawa) on September 24, that is 14 days after USCIS signed FedEx as received, this worries me because if I possibly also receive the receipts of I-485 on September 24, which means it would be after September 11 and would affect the new USCIS standard . This should not be possible, 14 days later ...
I appreciate any comments in advance!

Hi Everyone .. I have question , can someone explain to Us ..  Is the New policy apply to all applications and forms USCIS will receive it after September 11  Even on I 485 and i 765 applications too ?                                                                                                             The new policy it says when required initial evidence was not submitted or the evidence of record fails to establish eligibility !!  Such as what ? What kind of paper or evidence or record fails to establish eligibility they are taking about ?
