Términos y definiciones de violencia doméstica
El Departamento de Justicia de los EE. UU. Define el término general, violencia doméstica como "un patrón de comportamiento abusivo en cualquier relación que utiliza un socio para obtener o mantener el poder y el control sobre otro compañero íntimo". El Departamento de Justicia continúa señalando que la violencia doméstica "incluye cualquier comportamiento que intimide, manipule, humille, aísle, atemorice, aterrorice, coaccione, amenace, culpe, hiera, hiera o hiera a alguien".
El Departamento de Justicia define los tipos de violencia doméstica como sigue:
Abuso físico: Golpear, abofetear, empujar, agarrar, pellizcar, morder, tirar del pelo, etc. Abuso sexual: Coaccionar o intentar forzar cualquier contacto sexual de comportamiento sin consentimiento. If it's written that your depression is caused by the abuse suffered then part of abuse claim you can prove in your VAWA petition,but you still have to tell your story and convice USCIS that you were abused.If the depression is not connected with the abuse suffered then you can't prove abuse.It depends on what the psychologist wrote in your evaluation.

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I was reading about a new regulation of verification of credit history and credit score for those applying for the Green Card. Based on what I read, USCIS will consider your financial status before delivering the Green Card.
I understand that the new "Public Load" rules will not affect Vawa applicants so I would like to know if Vawa applicants are exempt from this new regulation or if, on the contrary, this measure would affect the petitioners of the I- 485 through Vawa (I-360).
On the other hand, I was thinking about checking my credit history at CreditKarma, but given our immigration status I would like to know if doing so would not bring any negative consequences, so I thank you in advance for your opinion before doing so.

USCIS will not check your credit score. Where did you read this? On an official .gov website? 

It is normal for immigrants who have not been here for long to have no credit history/score at all, so that wouldn’t make any sense. 

But yes, you can go to Credit Karma or other websites to check your score. These are privately owned websites that have nothing to do with the government. You seem very scared, you don’t need to be at all. You have a pending immigration petition, so you are allowed to be here.

Hi guys, quick question. I am moving and would like to change my address with USCIS. To my understanding it is not possible to change it online since I am a VAWA filer, correct? Would I have to send a letter to VSC in order to change my address and then do an InfoPass? That's how I remember some posts from VJ, but not 100% sure. I'd appreciate if someone could remind me of the process. Thank you! Have a blessed day everyone!

Yes, you can’t change your address via phone or online as Vawa filer.

 

I sent to Vermont, change of address form twice, both are notarized and signed. No single response at all (last time I send them was 4 months ago). So I am going to do an InfoPass next week to find out. Will let you know then!

Good morning, i just received a phone call from my lawyer and he is telling me that he called to find out more info about my vawa and they told him that they are looking for divorce decree, we are not divorced and the lawyer is telling me that i should start the process to get divorced, will this in someway affect my vawa !?
