i Suggest doing it asap, because they might not reauthorize VAWA this year. Meaning no one can apply for vawa in the next 5 years. Vawa was reauthorized around this months on 2013, but no one in the congress is willing to pass it before it expires.. I'm not sure what would happen next :/

Do it ASAP.... Vawa may not get re-authorized.

Please help me understand what they say, in case the congress does not sign the Vawa law again:
I ask:
1. People who have a Vawa case pending approval, if necessary, will USCIS send you an RFE or will you simply be denied the case because the Vawa law would no longer be active in the congress at that time?

 

My question is given by the fact that they are suggesting that they send the complete case, implying that if the Congress does not sign the Vawa law again, then USCIS will not send new requests for RFE.
 

Please clarify!

Dear @Damara, @sandranj, and all Vj members with experience,

Does low cost health insurance(not exactly medicaid but given at state level) count as public benefits ? I recently got a job and I got health insurance from my employer so I'm going to cancel the one I got from state because now I have based on work. Will my GC be affected based on that health insurance? Also, my ex was using Obama care and I was his beneficiary, will that count against me in the future?

The case, which was filed before 30th September 2018, should be eligible for approval even if it is pending.

Hi folks.  The Departament of Homeland Security released an unofficial copy of the proposed rule of inadmissibility on Public charge grounds, and the public charge inadmissibility  ground does  apply to VAWA petitioners. They will discontinue  form I864W. The rules will become effective probaby in January 2019.

 

If you want to read about the VAWA exemption I am posting here the unofficial copy, read pages 85/88 (4.EXEMPTIONS) and § 212.23 Exemptions and waivers for public charge ground of inadmissibility, pages 431/433

Low cost health  insurance  does not count as a public benefit.  Vawa applicants are not subject to public charge ok.

She asked yes/no questions. Then she was asking questions about my marriage, some dates, when I left, how we met each other, if he was married before, if he has kids, when we separated and why, she asked, couple questions about my first marriage too. She was writing some notes. In the end I asked about political asylum if I need to do anything with that now. She said just wait for your approval notice first and then send them the letter letting them know that you have GC. 

In the end she said they need to review my case, do background check, and visa availability or something like that and they’ll let me know the decision. 

In the paper she gave me says: “A decision cannot yet be made about your application. USCIS will send you a written notice regarding your application.” 

 

I dont know what to expect. Does anyone know how long usually it takes to get a response? 

 

 

I assume that you are not in removal proceedings,  you will be fine. Usually they take 5/10 days to approve the GC, despite I  saw some cases that took 2/5months for approval after  the interview.

Thanks for the reply! I was worried that paying a few bucks in premiums per months and the rest being paid by state wd affect me. What about the Obama care under which I was as a beneficiary? Although  i hardly ever used that health insurance because ex would not allow me to seek medical treatment

If your number is current you can submit your I-485 now.Go to infopass to find out your AOS case number.

 The public charge inadmissibility  ground does  apply to VAWA applicants  and it will not aplly in the future either.It means VAWA applicants can use public benefits now without any problem  and they can  use public benefits in the future as well, if they don't make  modifications in the  unofficial copy of the proposed rule of inadmissibility on Public charge grounds.

As i mentioned before Vawa applicants are not subject to public charge.
