If you wanna find out if your previous I-485 is still pending, just take the notice you got back then with the case number on it to an InfoPass appointment at your local office. They will be able to tell you if it is pending or not.

My new employer is willing to petition my green card. I qualify for Eb-2 category (Masters degree + 5 years of experience). My issue is that I just filed for VAWA and received my EAD to resume employment while they start processing my stuff ASAP. 

1. Can I have two petitions open with USCIS? AOS through work takes about 6 months.

2. Vermont service center also processes AOS for employment-based green cards. I’m worried it may cause some confusion. What do you advise?

Ask the attorney where is written in the immigration  Law that a person who has a pending l485 must file another one ,because all USCIS memorandums state to use the pending l485. Ask him to give a plausibly explanation why to file a new AOS  if the previous l485 is still pending, in my opinion the only reason behind his intent is to charge his fee for submitting a new AOS.

You can apply for EB2 visa if you have a pending l360, but you can apply for EB2 visa just if you are maintaining lawful status since you entered the U.S,If you are illegal here you  qualify for EB2 visa just  if you entered the U.S before 2001.

We never went to my interview on January 2016 due to abuse, so Feb 2017 i filed for vawa with all the FORMS without withdraw the previews petition i didn't know that i was supposed to withdraw it first, just recently my I 360 was approved  July 2018 and August 6 they transferred my I 485 to another office then August 9th my local office received the new I 485 base on vawa.

Now do i have to withdraw the first I 485

That my abuser submitted ? I beleive it's still pending, now i am confused

 I answered one question like this one before but let me clarify something here.It’s not advised to file a new AOS when you have a petition to adjust status pending, but it doesn’t mean they will deny your case because of this but you will pay your attorney  fees to file a new AOS when in reality you don’t have to hire an attorney to file a new l485.

Hello everyone! 

I had GC interview today. I went by myself without an attorney.  I took all the documents and copies with me. The lady officer was really nice, there was  another male officer sitting in the room. 

She asked yes/no questions. Then she was asking questions about my marriage, some dates, when I left, how we met each other, if he was married before, if he has kids, when we separated and why, she asked, couple questions about my first marriage too. She was writing some notes. In the end I asked about political asylum if I need to do anything with that now. She said just wait for your approval notice first and then send them the letter letting them know that you have GC. 

In the end she said they need to review my case, do background check, and visa availability or something like that and they’ll let me know the decision. 

In the paper she gave me says: “A decision cannot yet be made about your application. USCIS will send you a written notice regarding your application.” 

 

I dont know what to expect. Does anyone know how long usually it takes to get a response?

I believe you will be fine!!so don’t worry much ,please did you file your 1-360 alone?and please if you did file for EAD after Vawa approval please can you share your time line please?Thanks

So before VAWA case I filed for political asylum in February 2016. After 3 month of the receipt notice I filed for EAD card and was approved. 

I had I-130 approved from the marriage. 

 

12/5/2016 - filed for vawa. 

1 RFE for good moral 

3/22/2018 - vawa approved. 

I didn’t apply for EAD through vawa cause I already had it from asylum good till the end 2019. 

5/17/2018 - filed for Green Card

9/7/2018 - got interview date letter 

9/24/2018 - Interview day, case pending now.

Be positive, hopefully everything will go just fine. Apparently they just want to check some info and then give you your GC. Best of luck, trust in god! 🙏🏻

Yes, i made inforpass to ask The notice, but got nothing, unless the officer in local didn't know anything.

I had to wait until over 2 months to get updated approval done.

Hi guys , i am silent reader to this vj my timeline is here below

I 360,485 , EAD applied in -March 2017

receipt notice-March 2017

Got EAD in may 2017

got rfe for good molar character and bonafide marriage in May 2017

recieced response for rfe in May 2017

no prima facie u til now

my mom passed away can’t travel later applied AP

Ap approved in dec 2017

travel to my home country for 3 weeks in jan 2018 after 14 years lived here illegally can’t even go to my moms funeral 

came back safely 

renewd my EAD in feb 2017 got new card in June first week

Today got new message  new card being produced 

what is that mean?
