Please congratulations,did you file for Vawa separately from green card?please can you share ur timeline,I file for -1360 only since my spouse was a green card holder and I have wait for my approval before filing for green card.My lawyer told me my priority date will be current this October before we can file.

Did you apply under category C9 or C31? 

Is this your first EAD or a renewal?

Biometrics are typically about a month or so after filing. Just stay patient. You will receive the notice soon. 

EAD approval should be 3-5 months after receipt date (08/30 in your case), so I would think you will get your EAD by the end of the year.

I did see a lot of mention online about recommending to send a statement with your n400 saying how you were eligible and to include specific memos (if you want the memo links) So it seems USCIS is having some difficulty knowing how to accept these still. If you mail- you would mail based on where you live- theres no special instruction to send to Vermont. You may just have to wait and see if you get the packet back (so I guess an electronic rejection?) or if it takes a bit but gets accepted. 

 

I’m getting ready to file N-400 based on VAWA and I certainly will be applying for a fee waiver.

 

 I can apply 3 months to my 3 years of residency. October is the best month to file  so I’ll be filing next month.

 

i need to make sure my taxes owed are resolved to avoid any issues.

 

It is already approved in the name of Jesus Christ.

Hi guys                                                          I have Multiple questions .                          please Need help . It's Complicated situation .I am try to help My sister and Until the End will do my best to help her , she Suffered a lot , She had previous I 485 her husband filed for her , On interview date he refused to go with her to interview and she went to interview by herself to try reschedule appointment when he refused to go with her and he told her that he doesn't feel good and he is sick , he also said he is going to see doctor that's was just excuses form him  , He abuse her .. When she went there they asked her to send  them evidenced from doctor or something and reasons to reschedule her interview but she couldn't send anything because her husband refused to give her any evidence to reschedule appointment .. After that day he abuse her More .. We think they put her case on hold and we guess that what happened .. After that She filed I 360 vawa she had good case , we found out to transfer I 130 to I 360 we have to send I 130 approval along with I 360 application but she didn't have I 130 letter her husband has Most of the papers which they filed , So she been told to forgot it about this case now just focus More on I 360 and there's 2 options after you get vawa approved either we will try to transfer I 130 to I 360 or USCIS they already transferred  automatic because they have all information the last option File New I 485 .. During the time she is waiting for i 360 decision , she tired to renew her I 765 from her pervious I 485 we weren't sure if still pending or not , but was actually pending still and she got new cared and they renewed her work permit once .. Later on they they get divorce , and recently her work permit  expired again and she sent application to renew it for the second time but we didn't get decision yet just only they received case and finger print review completed , she wanted to work .. Recently she received c 31 which is mean her I 360 approved but she didn't received approval letter yet .                                                             Now her lawyer told her after she received c 31 that we need to file New I 485 based on vawa once we receive approval letter and we don't have to withdrawal pervious I 485 just leave it the way it is .                                             please we need help what to do Now    1- Should we file New I 485 ?  pay fees again to file new I 485  not a problem at all as long that's right thing to do ?           2- Do we have to withdrawal pervious I 485 ?  Is it Necessary to do that?                3- USCIS they already transfer her I 130 to I 360 automatic ?                                  4- Do we have send new I 485 along with w 864 and new I 765   she is already has I 765 still pending from pervious I 485 No decision yet ?               5-Now she got c 31 .. Do we have to wait until we receive approval vawa letter then we start file new I 485 ?  her ex husband USA citizen -  How long it takes to receive approval letter after sending c 31 card ?                                                 Please we need answer ! What to do!!

Hello everyone

 

I been through emotional and physical abuse and violence by my husband after marriage. We lived only a month together and I left him because of his constant torture  and humiliating behavior including racial abuse as well. He extorted a lot of money from me as well by giving threats of calling police on me. I have filed divorce as well and my attorney also going to file VAWA by end of this week. I have collected all related evidence of abuse and all necessary documents too. But I am worried about the time duration I lived with my husband. As it is only a month, is it gonna make my case weaker? Please advise me , these days I am literally feeling scared and struggling with my mental state as he still haunts me and the abused I faced too

i lived with my wife for 1.5 months but my vawa is not yet approved if u have enough evidence u should be fine :)

You should have never left the scene of the crime and you both should have helped the hit and run victim. You both fled and that will not go towards you.

I got the lease in my name with my tax ID and proof of income, since my abuser had past eviction before we met and she could not rent. So I added her to the lease.
I was not allowed to the apartment since June, when she brought her family and friends to stay. Aside othe abuse. 

The constant threath of deportation or withdrawing of petition makes me to be quiet. Though i paid the rent each month. I mean i pay all the rent and bills. She abandoned the petiton and that is the reason I filed VAWA. The lease expired last month and i went to discuss my situation with the lease manager that I will not renew the lease. As i cannot continue with the burden of paying rent, since i am not allowed to live there and the marriage has become something else.

The Lease Manager said my abuser has to sign the form that the lease will not be renew. She didnt sign. And i told the Leasing Manager that I will not encourage her by paying the September rent, rather i prefer it goes to eviction. Sp she can leave.
And when my abuser leave the apartment i will pay whatever is on my record. Not before she leave. Will the eviction have any effect on me or my petiton? Will it be on my record since I dont have social at the time of leasing the apartment. I used my tax ID. 
Kindly advise.

I had the divorce courts force my ex to release himself from the lease. An eviction will only affect your credit with future rentals.

FOR ANYONE WHO FILED EAD-

Currently USCIS is extremely backlogged and processing times are taking 5-8 months to get your EAD or EAD renewal. The processing times posted are not accurate.

 

IF you are doing a renewal you may be eligible for the 180 day auto extension-

You would have needed to properly filed for a renewal EAD before the current  EAD expired, and
you sent your application that is still pending on January 17, 2017, OR your Form I-765 renewal application was filed on or after Jan. 17, 2017. This is for C09 and C31 filers. 

 

If you are in desperate need of getting your EAD you can try to expedite based on financial loss. Many people recently have been doing (abusing) this and they are starting to deny expedite requests but its free to ask for an expedite and cant hurt if they say no. If anyone wants more info on how to expedite just ask. There is also plenty of threads about it in the main forums.

I can understand why you feel that way and Im sorry its like this. When they officially post something Im hoping everyone here will write to their congressperson and object or sign a petition. It really is 'unAmerican' the way they are trying discourage immigrants.

Anyway nothing has been released except a leaked document. If the policy does go forward all experts agree they would need to have some sort of grace period (ex- starting Jan 1 2019 any benefits will be counted against you or something like that) they can not penalize you for something you did that was legal in the past. 

Currently immigration groups and attnys are recommending that people only take assistance if they REALLY need it and should look to get off it as soon as possible. 

For clarity purposes - the proposed rule will not impact those who are GC holders wanting to naturalize. It also will not impact those adjusting through VAWA- they still will not be able to consider past public assistance for VAWA applicants when deciding if you are a public charge concern for AOS.  It can impact you if you are going to petition for someone else. (are you planning on doing that? If not then it really doesnt impact you directly)

There are many lists of what programs qualify as assistance and what doesnt. Because there are so many available programs not everyone is on a list. You have to look at the specifics of the help you are accepting. Is it funded by the government? Local? federal? etc.

Generally speaking most community health centers offer sliding scales or reduced cost or even free cost and that is not considered public assistance. I know you said before you were sick- and you dont have to say, but what kind of sick are you? Physically? Mentally? Do you have a specific diagnosis? There are many low cost options if you do not want to use whatever public assistance programs you may qualify for. I can help you find some places if you need help. Just let me know what kind of medical issue it is and your state and county. (here or in a PM)
