Hello everyone!
Days ago, Sandra and other collaborators clarified that Vawa petitioners can receive help without affecting their eligibility, but that this could change in the future and I really do not want to take the risk.
Given the new regulations of the new administration on this subject, I would like to avoid receiving any type of help that could affect me, so I would like to know if the assistance offered by the "Community Health Center" to people of low resources is considered help social of the government.
Please Damara, iwillsurvive, Sandra and other collaborators help me better understand this doubt.
Thank you....

Hi I have questions!

Here is my background of filing.

I filed 360 in sept 2017

got RFE on GMC so sent documents and they received it nov 2017.

Also filed for 485, 765 later in oct 2017.

So my attorney and I sent 765 renewal and on check status it says “fingerprint review is completed.” But I am concerned that my attorney sent it to national center instead of vermont.

Question 1. Is it ok to send it there instead of vermont?

And I also wanted to file for AP this time, so we filled up a form for it and I signed. My attorney said she sent it to different local center not along with 765 renewal.

And Last time I visited her office, I was able to get Receipt of notice for 765 renewal but not for AP.

She said it takes more time which makes me doubt for her not filing from the beginning. Because she did not want me to leave US and travel with AP.

Question 2. I want to have faith in my attorney. Lets say she filed. Is it ok to file AP to different location not with 765?

And if it doesn’t print on my new EAD card “valid for re-entry”

do they send it separately?

And recently

I changed my address of 360 by sending a letter to vermont.

But I have not received any notice that it has been changed.

Question.3 i sent the letter and a form in august 2018. Still no update. is it changed? Or do they usually give notice?

From looking at shared stories in this forum, I am expecting my 360 approval probably somewhere in april or may 2019.

And if my case gets approved,

they will probably send the approval letter and then

question4. what happens next till interview notice?

approved and wait for few more months, then i will be receiving another letter for interview date?

I originally filed I-485 in Miami, FL then moved to Houston TX after splitting up with my ex to live with relatives. I came back to FL and also requested change of address. I sent Vermont center 3 notarized letter requesting 1. change of address. 2. Remove my attorney from my case as I had to fire him, he also said he filed EAD but never got a receipt or evidence (lied)

3. Prima facie extensión.

I sent everything Jan 26 and they only updated my case in March 13... I haven’t received a confirmation or anything.

All I could think of doing is request a change of address on USPS so they can re-route my mail from my old address to the new one.

1. As a VAWA filer, ALL forms and renewals that you file have to go to the Vermont Service Center. Your attorney has no idea what he is doing, he seems to not have experience with VAWA. Your attorney should have filed I-765 and I-131 renewal with the VSC. The office he sent it to will probably transfer your renewal forms to VSC eventually but that can delay the process.

2. Again, as a VAWA filer only Vermont is responsible for you. You attorney has no idea what he is doing. But it is true that different forms have different processing times, so it can be that receipt notices come in at different times. If they don’t issue a combo card, they will send you an EAD that says “not valid for re-entry” and then you will receive your AP as a piece of paper.

3. USCIS will never send an update about adress changes. If you want to verify that they changed it, make an InfoPass appointment at your local office and and ask them if they can see the changed address in the system.

For the forms you filed, it usually takes up to 4-6 weeks to receive receipt notices.

4. Keep checking the official processing times page as processing times can change every month. I have seen them go from 9 months to 16.5 months over the last 1-2 years. Currently it is 16.5 months. https://egov.uscis.gov/processing-times/

After your I-360 approval, your I-485 will be transferred to your local office. Your local office will then send you an interview letter according to their processing times. Every local office has different processing times but you can look them up at the website above. Depending on where you live, this can be anywhere from 4-18 months after VAWA approval. Even once your I-485 is with the local office, you will still renew I-765 and I-131 with Vermont.

I suggest you read through this forum to get more familiar with the VAWA process as it seems like your attorney is misinforming you and is making many mistakes.

You can make an InfoPass apointment at your local office to verify that they changed your address in the system.

Hello everyone.

Is syphilis test still a part of the requirement for a i485 medical?

Thanks for your response.

Yes, it is. You can find everything on form I-693. Part 7: Civil surgeon worksheet has all the testing.

https://www.uscis.gov/i-693

USCIS states that below diseases make a person inadmissable to become a permanent resident.

https://www.uscis.gov/policymanual/Print/PolicyManual-Volume8-PartB.html

A.  Communicable Diseases

Applicants who have communicable diseases of public health significance are inadmissible. [1] The Department of Health and Human Services (HHS) has designated the following conditions as communicable diseases of public health significance that apply to immigration medical examinations conducted in the United States:[2]

Gonorrhea;

Leprosy, infectious;

Syphilis, infectious stage; and

Tuberculosis (TB), Active—Only a Class A TB diagnosis renders an applicant inadmissible to the United States. Under current Centers for Disease Control and Prevention (CDC)guidelines, Class A TB means TB that is clinically active and communicable.

They are currently working on May/June 2017, so you should hear soon hopefully. There are still people from January/February 2017 though that haven’t heard yet.

Did your attorney explain why he wanted to wait to file I-485? Does he not believe your case is strong?

Yes you can always file them together. Just know that if you only file I-360 and it gets denied, you will not be put in removal proceedings.

If your I-360 gets denied and you have a pending I-485, you will be put in removal proceedings.

Talk to your attorney and explain you would like to file I-485 and I-765 category c9. Ask if there is a reason he didn’t file them concurrently. Your attorney knows your case best, so see if there is a reason. If not, then file I-485 and I-765.
