Yes the i485 will transfer automatically to NBC after VAWA approval. You should get your appointment pretty soon.

It’s been a while since I posted. I’m an August 2017 applicant... haven’t had any updates.

 

I need to renew my EAD I originally got based on I-485, that case is still pending and i did t know I could renew as a vawa applicant... I’m  already divorced from my abusive ex husband.

I was arrested but not charged for domestic violence charge (misdemeanor) when I threw an ashtray at my ex. Case was dismissed as he didn’t press charges.

If you have a valid pending I-485, you can renew your EAD in category C9. You will need to send this to VSC. Criminal charges have nothing to do with EAD approval. You might need a waiver in order to get your I-485 approved though.

Current processing times can be found below.

I-765 under C9: 3-5 months 

I-360: 16.5-20 months (seems like they are currently working on May-June 2017 but some earlier ones are still waiting)

If you’re medical was done over a year ago, do one. Take your passport, social security number, the interview letter, I-94. Take along as much of the evidence you submitted with your vawa application, as you can never know what they’ll ask. 

When the Officer asked why did you over stayed your visa what was your respond?

Thank you! I’m just confused bc you have to be married in order to file on c9 category and I’m already divorced... don’t know whether to list myself as divorced on it...

 

Also, will I need two separate interview( I-360 and I-485) or they approve your green card right at the same time?

She only asked biometric questions, and my parents names, when I arrived, the yes/no questions, and she said, not asked “you mentioned you accepted public benefits..”, to which I answered “yes, ma’am”, as apologetically as I possibly could. For six months I accepted food stamps and cash.

everything went will and my ex husband knew that he is not going to get what he wanted because he know it was not true, the judge judged for divorce but its going to take some to be finalized! 

 

Stay Strong and you will get over it, the court knows that the only reason they do that is to hurt the other person there is no other reason to justify that behavior,

what he is doing is going to coast him a lot of time and money he will eventually give up!

My ex didn't give up just to warn you. He spent the money but you will be ok. As you said the courts know people get nasty. It will probably just take a while to get divorced. If you have debt together make sure you ask for the money unless it's in his name and request everything joint is closed. It all has to be in the final decree. You need to think about protecting your credit score if you have joint financial responsibilities. And if you can't afford all the bills even your own as for the money. My ex had to pay my renter's insurance for a year and half our joint lease he abandoned plus my car insurance for a few months and half the debt. If you have pets make sure that's set out in the decree too stating who gets the pet. And make sure you read that final decree. They got it wrong and I had to file to amend it. They still got it wrong and the judge corrected them. It's all a pain but worth it in the long run

You don’t have to be married to file I-765 under category C9. Not sure where you got this information from but it is incorrect. The only condition for C9 is that you have a valid pending I-485. 

 

There is no interview for I-360. You will hear from USCIS about I-360 after around 16.5 months after your I-360 receipt date. You will either get an approval letter or a request for further evidence if they still have questions. After your VAWA is approved, your I-485 will go to your local office. Every local office has different processing times. Most take anywhere between 6-12 months. You can look this up on the USCIS website. You will receive an interview notice for I-485 from your local office. Then you have the interview and get your Green Card.

Wow this is great!! Thanks for all the info. Sadly I spend all the money i had with an attorney who didn’t know very much about vawa. He didn’t file for a work permit at the same time. He lied and said it probably got los in the mail.

It’s been a year since I filed  VAWA I’m keeping my fingers crossed we all finaliza this long process.

You don’t have to be but they obviously want to see that you are making moves to get away from your abuser, so it is advised to have at least filed for divorce and be able to prove that. USCIS knows that the divorce process can be complicated and long, so if it is not finalized, that’s okay but I would highly suggest to prove to them that you no longer involved with your abuser. 

Also from a personal point of view, I think you should get a divorce as soon as possible so that your abuser has no legal ties to you and so that if your abuser gets into debt on purpose, you don’t have to pay for it.

It seems like your attorney didn’t explain the VAWA process well to you at all. I suggest you read through this and previous VAWA threads. There is a lot of experience on this forum.
