So,he quickly filled i360 and after write to USCIS field office that will adjudicate my i485, with a copy of i360 and UPS mail tracker of i360 sent to Vermont,for them to hold my i485 in abeyance, he put it in the letter that he will send the receipt number of i360 to the field office as soon as it is received.

He said he has to do this quiclky so that the interview will not be considered as abandoned and my work permit cancelled.

What is your comment has my attorney did the right thing so far?

Your lawyer sounds like he knows what he is doing and like he cares about your case. Stick with him/her! 

What your lawyer is suggesting is your best option when it comes to immigration if your spouse is not willing to show up to the interview and is abusive. 

My recommendation is to file for a restraining order and a divorce as well.

please before joining this forum I sent my VAWA application with the declaration statement of just 4pages and eventually I ready on this forum that at least a minimum of 6pages is required(my lawyer never says anything about it and now am scared).

my question is that should I wait for RFE before sending another declaration of more than 6pages or I should not wait for the RFE before sending them to Vermont .

@Bryan,let me tell you something very important,seriously everyone comes to this forum and tell you they send more pages of personal affidavit the truth about it is that is not how many pages you sent,it’s what you wrote and very well explained!!for instance I sent in 4 pages of affidavit and explain everything details and many people here said you must sent evaluation from a psychologist that’s not true too although some people need it,my lawyer didn’t sent mine cus I had hospital records of my health during that period so I will advise you to be patient whatever they need they will send you a rfe!i read a lot of things here and I was so scared almost to the point that I was about doubting my lawyer but my case was approved without any rfe.and it all depends on the person working on ur case.So don’t worry and put your faith in God everything will be alright.Ask Sandra she will help you too

I had my case approved may 30th. The approval letter didnt arrive yet. What happened after your approval? What come next ?Thank you and congratulations!

I dont know. I think he should still go to the interview. The mail system is SLOW and can be unreliable. the attny sent a letter to VSC. His case is in a local office right now. So VSC has to get the mail, sort the mail, get it with his file, have an Officer review it and do whatever they do to process it, notify the local office that hes not coming/hold the 485...  I dont know if thats going to happen and him be able to verify that it happened before his interview date. If he is marked as missing the interview it can cause additional issues to fix. Its not a big deal to go to the interview and tell the Officer you have filed for VAWA. If he has the NOA receipt he can give it to them, if he doesnt its okay. USCIS does not have to hold the 485 but they almost always do.

Thanks for yout comment. From what i wrote earlier. My attorney sent i360 for to Vermont.

And sent another letter UPS priority mail to the local office that will adjudicate my i485 with a copy of i360 and the mail tracker of the actual i360 petition sent  Vermont. This was done a week ago.

Thank you. Congratulations on your approval as well. I don’t see what’s holding your approval letter. You should make and info pass appointment.

After approval of Vawa, if you had filed i485 Along with  i360,  they will transfer i485 to NBC after which you will receive your interview appointment date.

If you haven’t file i485 as yet you should go ahead and file as soon as you get your approval letter.

Dear @Damara @sandranj and other members with helpful information,

I filed VAWA last year and I have since then renewed my permit once, this is after I got the original work permit with my new VAWA package which I sent in after abusive ex souse withdrew petition. My question is that although I have moved away from my ex,(we are legally divorced), he is still in touch with some of my friends and relatives. Some of these people are not my well wishers and may be giving him information about me and that I have filed VAWA. The thing is that some of my VAWA mail went missing and I placed it in a secure location so I'm not sure if evil relative has it or even sent it to my ex!  Will this, or naysay from other non-well wishers have an impact in the VAWA decision? I'm currently saving up to get a place of my own so that I may move away from relatives place where I dont feel welcome. 

Any helpful response will be appreciated.

There are specific provisions that prevent ANYONE besides you or your attny on file from getting any info on your VAWA case, they wont even acknowledge that you have one. Also USCIS will not consider anything your ex tells them (if he does) when deciding your case. If someone has your vawa paperwork theres not much they can do with it/ they can create an online case tracker and see that stuff but so what? its none of their business and they would be committing a crime but i cant think of any way it could harm you.

Get yourself a safe deposit box at the bank. Small ones are pretty cheap. Or give all your important stuff to someone you trust to hold but your own box is the best option (sometimes the only one we can trust is ourselves) Most importantly get yourself out and away from relatives and friends who are not supportive. Find a room to rent, check by colleges even if you are not in college or college age. talk to the landlord/homeowner and tell your story and see if they would rent you the room even though you dont go to the college. Obviously there is student housing which you dont qualify for- Im talking about homeowners that live near campus and make money by renting out rooms to students. They can rent to anyone they want.
