27 Sep 2016: Prima Facie letter 

15 Oct 2016: EAD expired, last day at work.

 20 Oct 2016: Decision notice - declined EAD (filed before divorce).

19 Jan 2017: resubmitted I485, I765, I131, with new medical results and respective fee waiver forms.

23 Jan 2017: Fees waived on all applications (saw this after I received physical notice with receipt numbers)

02 Feb 2017: Receipt notices in mail. 

01 March 2017: We ordered your new card

03 March 2017: Notice received in mail

06 March 2017: We mailed your new card.

08 March 2017: Card received.

25 March 2017: Notice of Action - Biometrics 

01 April 2017: Biometrics appointment letter received in mail. 

Since then, I have sent applications for Prima Facie extension. 

Nov 2017 : RFE, Good moral character, background check from country. I wasn’t in the US 3yrs when I filed VAWA.

Jan 10, 2018: Sent RFE response, along with Prima Facie Extension application. (I didn’t think to apply for EAD renewal at the time...not good...I didn’t understand it wasn’t based on a valid Prima Facie, but a pending I-485)

Jan 11, 2018: Notice Of RFE receipt

Feb 20, 2018: Realized my mistake with my EAD, quickly sent in application, with letter asking it be expedited. 

Feb 20, 2018: Contacted Senator’s Office for assistance. 

Feb 28, 2018: Update On I-360 case....”Initial Review”. It said they received correspondence. I suppose they were contacted by the Senator’s office....because I already received notice when I responded to RFE for background check. Plus, the I-360 wouldn’t update because of the receiving my EAD renewal application, right? 

Feb 28, 2018: All my documents expired. I am now out of a job...no one to blame but myself. I just pray I get my new EAD soon. 

Mar 10, 2018: Notice: Fees waived for I-765

Mar 12, 2018: I-360 Petition Approval Notice!!! 

Praise be to God!!!! 

 

UPDATE

August 14-25 Interview letter sent out and received.

 

September 11 - Interview date. 

 

Please keep me in your prayers. I will share my experience as soon as I get out of it.

Yes it was EAD Renewal form previous i485 that was sent to NBC not VSC they accepted and sent me receipt don't know if they will transfer to VSC.

If u don't have I-94, maybe i am not sure the applicant need to file for a waver to remove the illegal entry base on vawa approval letter.

You can use the early filing calculator USCIS has to determine when you can file. You can also file online- someone in the VAWA thread just filed online a page or so ago and is having problems- so you may want to do a paper application.

You submit basically everything the 5yr application would require, you are just eligible at 3 yrs. The 3yr requirements include proof of bonafide marriage- you dont need that, just the VAWA approval. Go back a page or two and find the links I posted about how to include a letter of explanation showing how you are qualified to file for VAWA. If you need more help, post back and Ill see if I can find a guide geared towards VAWA applicants. But VJ should have a general guide and example form.

They CAN NOT ask you about the abuse. They can not ask about the validity of your marriage,  residing with the abuser, etc. Basically when VSC approved your VAWA- that was it. A decision was made about the abuse and the Officer can not revisit or question it. If they attempt to question you about the abuse politely state USCIS policy prevents them from asking about abuse and request a supervisor if needed. Most dont question about the abuse- so its usually not an issue. I just want you to be prepared just in case. A lot of attny adverts suggest Officers like to 'take advantage' of those with out lawyers- hence why you need them. lol.

Unless you have some other issue- a general AOS interview is them reading you the yes/no questions from the 485. Verifying employment and address history. Sometimes they will take your i94. If they do its usually a sign you are going to be approved. Sometimes they dont take the i94. That doesnt mean you are not going to be approved. Different officers have different ways of doing the paperwork. Dont stress about it. 

Do you have an attny? Usually part of their VAWA duties as your attny includes going to the interview with you.  They can not answer any questions though. Also in no way am I saying be careless about the interview- it is important. But worst case scenario- it goes horrible, you get into an argument with the Officer- whatever- you will get a 2nd interview and can have a lawyer go with you for it. The i94 is just one of their paperwork verification things. If you dont have it they can find the info.

Damara, thank you very much for your response. I used the early filing calculator and it appears that the earliest I can apply starts on October 23rd of this year.. and that is after my wedding. Will it hurt my application if I am married to another USC when I apply since I am applying under 3 year rule of VAWA?

I think I already have the checklist of documents I would need based off other VJ's experience, but I couldn;t find the letter of explanation showing I am qualified for VAWA.

Hi Everyone,

My Sister got her appointment for I-485 adjustment of status next Tuesday sept 18, 2018. She is VAWA Approved. She is ver concerned about this appointment thinking she is going to be deported because she has an 9c bar from Juarez and she EWI again and file VAWA. I do have a lawyer but it appears she is nervous too. On top of that is going to be hard for her to attend to the interview because she has a speech in another state. She is offering to send an specialist in deportation, which I think it makes sense. I know her case is unique but please if anyone has advice or knows of someone who can help us will be appreciated. A while back when we file for VAWA someone told me here that she need it a waver, my lawyer has no idea, she tells me that they will ask for at interview. For sure her re-entry is tie to her husband abuse. Thanks everyone for you help. This is my e-mail [edited out] in case someone has information on a lawyer with experience with VAWA and 9C.

when completing USCIS Form N-400, on Part 1, Information About Your Eligibility, check box E for “other.” As an explanation, write "Have been an LPR for at least three years (VAWA I.N.A § 319(a))."

You may also want to attach a separate statement about how you qualify on this basis and a copy of the USCIS memoranda discussing the issue, including #1 Instructions Regarding the Expanded Meaning of Section 319(a) and #2 Clarification of Classes of Applicants Eligible for Naturalization under Section 319(a).

Your VAWA was approved. Both the 360 and the 485. As long as you are divorced you can marry anyone you choose. Sometimes people can qualify to file under multiple categories. For you- you can file at 3yrs under VAWA rule, 5yrs under general rules, and if you marry a USC but only when youve been both married to them 3yrs and an LPR for 3 yrs. (so that would be about 6yrs from now). You can choose to file under whichever eligibility you want. Most people pick the shortest time. So the above is how to show your eligibility so they dont reject it and you have to start over again or appeal.

Your sisters situation is very complicated. It is troubling that the attny does not have any idea. Where did you find this attny? Are they experienced with these types of situations? Can you meet with the specialist before the appointment or talk to them on the phone?

I had no idea about this can you please help me with erasing the post????????? I can for sure to an specialist over the phone, its only a week away!!!!!!!!! she is a family immigration attorney

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
