Not having a priority date means a # slot  is available for you immediately when your case is ready- you dont have to wait for a date to become current for the 485 to start processing.

My lawyer filled my VAWA, I485, I765, I131 together, I765 And renew EAD on C31 for the both. But i reveived my 1st EAD C9 (my VAWA wasn't approved), the 2nd EAD C31 with appoved vawa.

 

USCIS is too messy, i still don't undersatand their working to all applications differently.

If you have a pending I-485, I recommend filing all I-765 renewals under C9, so that you can work while your VAWA is pending.

I filled all applications together (beacause my abuser is USC) and I765 on C31, but my 1st EAD was coming in about 3 months after filling. But the 2nd was comming after 9 months to renew still on C31 with approval Vawa. 

 

I only showed as useful different  information to all the fillers.

I get it on USCIS instruction for VAWA.

 

VAWA PRIMA FACIE NOTICE  

. My client received a prima facie notice. Does she qualify for public benefits?

o With a VAWA prima facie notice, your client may qualify for public benefits. Please refer her to the nearest Illinois Department of Human Services to apply for benefits. http://www.dhs.state.il.us/page.aspx?

 

• Are there any immigration consequences if my client accepts public benefits with her prima facie notice?

o When applying for adjustment of status (Form I-485), your client will need to demonstrate that she will not be a public charge. Therefore, if your client receives public benefits, she should be working toward self-sufficiency by the time of the adjustment of status interview in order to demonstrate that she will not be a public charge.

It has always been up to the immigration officer at the border whether residents and visitors are let in or not. The only guaranteed entry into the US is for citizens. That being said, it is very rare that residents are denied entry. Most likely this can be due to having traveled outside of the country for 6+ months, having a criminal record or being from a country under the travel ban. It is not very likely that a permanent resident that is just going on vacation for a few weeks is getting denied. No need to panic. Just always make sure you have all your documents on you that prove your resident status and ties to this country.

Always check the USCIS processing times website for the latest information on processing. It gets updated once a month.

Currently it is taking 16.5 months for USCIS to view an I-360 petition and send out an approval letter or RFE. They are working on cases that were filed around May 2017.

@Aburi2018 The extension will automatically be sent out to you. However, if you need it you may want to call them or write them a letter because it will take a few weeks after the original one expires to receive the new one!

 

Question: How do you get financial aid with your prima facie? I haven’t been able to!

@JonShai thank you for clarification.I sent out a request for an extension.

-For financial aid,the first time I applied in this school they rejected the prima facie and said I couldn’t get financial aid with it.I came back again after 5 months,googled the information online showing I was eligible for financial aid with Prima facie and showed my admission representative.He took it to the financial aid’s office of the school and they did their research and contacted me saying i qualified.

@JonShai what did they say when u applied for financial aid?Some people have no knowledge about it though.
