Good morning everyone after waiting 16 months ..i got a RFE so disappoined though.

I know the feeling. i got one after waiting that long last year. The worst part is that, after you respond you go to the back of the line which sucks even further. However, don't rush when you respond to RFE. Take your time and do it correctly.

What category is work permit of US Citizen spouse that apply for VAWA and Sent form { i-360,  I-485 and waiver  to USCIS } but mark Part 10 number 12 of form i-360 to apply for work permit.

C9 if you have an pending i485 (which you send together with you i360 as you mentioned above)  This is the one to apply for now.

C31 category work permit will be giving to you once your vawa is approved.

With the current administration when you file I-912, don't you risk being labeled a "public charge"?.

I imagine the feeling... :( sorry to hear that. Im on my 15th month waiting, if that happens to me I'd try to take my time and respond the best way possible, like preparing evidence meticulously.

on the other hand, you should try to see the positive side; they are working on your case already.

God bless you, he's in charge of all of us! Be positive :)

@sandranj

Sandra is on a well deserved vacation.

I'm sure she will post something when or if the proposed policy changes take effect.

Currently VAWA applicants are not considered public charge for using fee waivers (or other forms of aid). I do not believe the proposed changes are directed at vawa, asylum or refugees. But again when the policy moves forward I'm sure Sandra will explain it for everyone here.

According to most attnys and legal aide groups you should continue to get and use anything available to you that you may need.

Oh wow. Well, the evaluation will help no doubt. But the thing now would be the time you have to respond. Like I said  try to get the most you can so you can send better proof. Idk, pictures, any paper that you considered insignificant could probably help.

I went to therapy and got my evaluation (which I haven’t sent yet) but in my personal opinion therapy helps a lot, it even gives you strength to continue this process.

Best of luck. Trust in god and he will provide!

Your lawyer should have told you to do the evaluation before filing for vawa, that's not good.

I know a lady in Newark NJ who did my evaluation butbi dont know any in NY

Anyone here lives in nyc can refer me to a not so expensive place to get my evaluation done

Ask your lawyer to help you out. I live in NYC and  it ranges from $800 to 1000. I asked around but I didn’t get one. R they asking for probe of battery? Did you submit Vawa under mental abuse and Physical abuse?
