I haven't seen any movement on it since approval. The last update said they scheduled my interview which was March 2017 (which was when we asked that it be held until VAWA had been adjudicated). Would you recommend an infopass? Hold off on paying this huge second retainer to see if the file is transferred? 

 

Your AOS will be transfered without your attorney asking USCIS. It's unbeliavable how some attorneys can mislead/lie to their clients just to get extra money.

Hi Sandra,

i have filled vawa with 485 ,after I filled vawa I have some evidence my ex wife throw the spoon on me amd it cut my eyebrow blood was bleeding but I don’t call the police i am indian guy I don’t feel comport to go to police station for family matter but I went to urgent care the took pic of the wound and put stitches on that can I send that to the Vermont center?also I have detailed affidavit from my brother in India about my relationship with my ex wife and abuse can I send that too but they didn’t ask me any rfe , I have filled in March 2017 and one rfe in May 2017 for Prima Facie I Tila evidence which is good moral character and bonafide marriage,but my lawyer said they might missed my documents in the beginning I submitted that’s why they are asking again he said , so he sent again documents he submitted in the beginning for good moral character and bonafide marriage along with some new documents.

these are my documents I submitted in the beginning 

marriage certificare

her birth certificate 

my birth certificate

affidavit from me and two from my friends about relationship and abuse which I told them( but affidavit or not too depth cause nobody came to our house)

one affidavit from I 130 her friend gave to us about our relationship 

lease agreement

bank statement 

photos together 

wedding pic on court house and dinner at restaurant 

both of us letters in same address 

medical records I have seen psychology doctor for the depression 

medical record from my primary care doctor when she twisted my harm

letter from domestic violence non profit organization 

psychologist counselor evaluation letter

county criminal record check for both county I lived

letter from temple

 

for rfe for Prima Facie for good moral character and Bonafide marriage I have sent the new evidence along with old ones

church father letter

irs letter stating our both names

 

Its been 16 months I haven’t received any prima Facie but I got EAD and Advance parole case status saying we received your response for rfe our Vermont center will begin working on your case.

i divorced my wife four months ago

please advise me can I send new evidence to them without rfe or should I wait plz help me.

Q: I feel, "Did my attorney made mistake by sending it to NBC?" or " My attorny should have sent directly to Vermont for fast processing as my I-360 is not approved yet.

VSC has jurisdiction over your case until your VAWA has been adjudicated. Your attorney should have sent the application directly to VSC I had a similar experience where the i765 was sent to NBC instead of VSC and it had to be transferred to VSC from NBC. I got my EAD relatively quick I think it was faster for me than some others I have seen, just bear in mind our experiences may differ. Just hang in there and keep your fingers crossed you may get the new card soon. Given that you are an April filer you tentatively could get your EAD under C31 soon also. I wish you all the best.

Mistake he should have sent it to Vermont since you filed vawa

If you have an approved I-360, you can apply for I-765 under category C31 or you can submit I-485 and I-765 at the same time and apply under category C09. You need to send it to Vermont.

Hi @ Military, i am in the same boat, my lawyer also sent mine to NBC instead of VSC, please how long did it take for you to get the EAD. What can i do in this situation, just wait or what? I hope i get it within 4 months, i filed vawa in March 2018 and EAD in July 2018.

I got my EAD in 3 months, the transfer didnt seem to delay the processing for me. I hope that you get your renewal EAD quickly as well.

You should discuss this with your attorney,but you can submit new evidence anytime before final adjudication.

Can you file i-360 and 1-765 alone without i-485?.

Yes you can just file I-360 and I-765 has to be under category c31, meaning you will receive your EAD after VAWA approval.
