Is it possible to get EAD while waiting for a decision to be made on i-360?.

Yeah of course. You can fill form I485 and I765 concurrently with I360 or you can send I485 and I765 after you send I360. I waited almost a year to send my I485 and I765  forms. I received my work permit in 4 months. Let me know if you need any help.

Ok..Just one more question. So  Can  someone who initially filed i-360  decide to file "i-485 and i-765" on a later date and be granted EAD?. or that would be considered too late.

@sandranj

I did exactly what you are asking. I sent I360 and then a year later I sent the two forms and got the work July 26 and I360 was approved yesterday.

It took like 16 months for my I360 to be approved. I couldn’t wait any longer so that’s why I decided no to wait for the approval of I360

Yes that is possible. You can file I-485 and I-765 at any time during the process.

Just be aware that you will be put in removal proceedings if your I-360 gets denied and you have a pending I-485.

Thanks. My attorney gave me a lot of misinformation. I suspected he was terrible but this just confirms it. This whole time i could have been working even had my ID renewed.

I have been waiting for a very long time.

Once in removal is that the end of the road. Can't you appeal or refile i-360 to buy more time?.

I suggest you read through this entire VAWA thread and also past ones. Lots of information in there.

Sandra replied to a question like this on page 11 of this thread. She is giving a very good answer, so I suggest that you read it. She is an attorney, so she knows the law the best.

I heard that there is a low chance of winning an appeal. You can always re-file but the second time you will need to find a competent lawyer in order to have a higher chance of approval.

What evidence did you send to USCIS?

Was there a reason he gave you for not filing the 485 along with the i-360? The only thing I can think of is If you're in removal proceedings then you can't file for 485 till your vawa is approved. @sandranj correct me if I'm wrong.

What evidence did you send to USCIS?

psychological evaluation from a professional

 tax transcripts.

banks statements.

affidavits from friends,family, myself

Photos.

copies of insurance policies.

Lease agreement.

Police report.

(these are the ones i can think of)

--The problem is that they wait too long to ask me for stuff. For instance i initially sent them tax returns but they waited 2 years to tell me that they want tax transcripts .

I am not in removal. He just said, they won't process my i-485 and i-765 until after they have made a decision on your i-360. So there is no point filling them concurrently. Another reason he told me is that he didn't want me to be put in removal in case they deny my i-360

Congratulations @Totoro_J May i ask what kind of extra evidence did you sent as good moral character? Did you also sent police criminal records / FBI?

Hi, I sent police clearance from state where I am living and from my country with original i-360 packet.

After i-360 sent, My spouse become more abusive, I send those evidences 4 months after i-360 is sent.
