My Us Citizen son is going to be 21 in 9 months. 

 

I don't know if I should appeal the denial,  redo VAWA or just wait for my son to be 21 so he can petition for me. 

 

I feel so overwhelmed and my mental health is not doing so well. 

You will still need a lawyer if your son files for you, and that one will need to be experienced in waivers.

After reading all the post about physiological therapy evaluation report much needed for Vawa cases even thou i have a police report and order of protection sent already in my case and I already received  Prima Facie letter, I did my search and find a counseling placer here in NYC they specialized on Immigration physiological evaluations Report for Vawa, Asylum, hardship, etc they are on the pricey side $1,400 (all sections included) but the Physiologist i spoke to,  told me that their evaluations report are minimum 12 pages to 15 pages, they detail everything on the report. My questions is How can i submit this physiological Report once i finish to USCIS ?? Do I need to wait for them to send me RFE or I can write a letter stating is a new evidence along with a copy of my receipt, or just wait until they ask more evidence.. Please advice me.

You received a blue letter with your Prima Facie that tells you how to submit additional evidence.

My case was received April 25 2017

 

The most common RFE’s are good moral character, bonafide marriage or more proof of the abuse. 

They send the RFE letter pretty fast typically, so just wait a little and you will know more.

VAWA was approved on July too

After transfering my I 485 to another office on August 6th, 2018.

Today i got an upgrade:

 

August 9, 2018

We received your case

You do not need to do anything at this time

We will begin processing your case and will review it to make sure you have submitted all of the required information and documents. We will let you know if we need anything else from you.

If you do not receive your notice by September 08, 2018, send us a case inquiry and select that you did not receive your notice by mail.

Jazminjuju you need a lawyer who can defend you like explain why you don't have proof of bonafide marriage and proof that you intend to spend the rest of your life with your husband not for immigration benefit then you will be approve

Timeline:

March 28, 2017: USCIS received my I360

I wrote a 4 pages affidavit

2 affidavits one from my mother another one from a friend they were like 4 pages each.

I included photos, life insurance, car insurance, apartment lease. 1 police report, letter from  a domestic violence counselor 1 page, I went to see a doctor for depression and I was prescribed two medications, Criminal record and 2 certificates of good conduct from two different cities.  I didn’t lie to USCIS and I sent a letter from my previous employer that I had worked for 9 years without work permit. My employer stated in his letter my good moral and excellent character.

 

March 15, 2018: I sent I485 and I765 and got my work permit July 26 2018.

 

I didn’t receive any RFE and I filled myself.

 

Today, I got a msg stating that there was an update on my case and that  it was approved and I should be receiving my approval letter in the mail. 

 

Congrats!!! Did you get  c31 card before approval?

No, I didn’t because I didn’t check the box on form I485 that states If I wanted to receive a C31 permit right after approval of I360. I just got my C9 on July 26 so when is time to renew, I will fill with category c31. Thanks

Hi @sandranj I just filed a 4 pages evaluation on Jan 2018 because I didn’t have enough therapies at that time. Now I have participated in 10+ therapies. Can I send an new evaluation to USCIS even though I don’t receive any rfe for evaluation?

Just be patient and see if USCIS sends an RFE. You never know. The evidence you submitted could very well be enough. It’s good that you are prepared and have a new evaluation but don’t send anything unless it is requested by USCIS. Maybe they just approve your case and don’t even send an RFE. You never know. Just be patient and continue therapy for yourself so you can heal.

Is it possible to get EAD while waiting for a decision to be made on i-360?.

Yes, but only if you have a pending I-485. Then you can submit I-765 under category C9 and you will receive the EAD a few months after submitting the I-765 form. 

If you did not submit form I-485, you have to wait until I-360 is approved to receive EAD (I-765 category C31).

Ok..Just one more question. So  Can  someone who initially filed i-360  decide to file "i-485 and i-765" on a later date and be granted EAD?. or that would be considered too late.
