Hi guys

I sent my VAWA application in August this year and they have received it on August 28th. 

I got RFE in september for GMC (police clearance) and they began working on my case again on October 23rd. 

I guess that will delay my EAD, since I got RFE?

 

Also one more question, with my application I sent my personal letter, joint accounts, statements from friends about abuse, pictures of my abuse (fractured tooth, knife wound) also statements from dentist and doctors (I have IBS stomach related problem because of stress), but I never sent psychological evaluation because I never went to therapy due to financial situation. 

I am planning to start therapy because my mental state is worse and worse everyday, so once I have the evaluation can I send it to them? Or they will isuse a RFE for it? That part makes me confused, since I don’t know how to do it.

your 360 was approved in sept 6 2017 or sept 6 2018?

Usually USCIS takes 90 days to issue the work permit but there are many people waiting for 5months.

 

THey ask proof or good moral character after after 30/90 days but request of evidence regarding  bonafide marriage and abuse they just ask when they will adjudicate the case, after 18/20 months.

RFE to prove abuse or bonafide marriage is not mandatory,the immigration officer issues if he/she wants,that being said when you have Your psychological evaluation done then submit to USCIS.

Or only my lawyer does ?

@Touna Hi. Only your attorney gets all the notifications, and then he/she will notify you. You can also set up an online account to track your case.

Thank you @sandranj for your help. God bless. If they request a bonafide of marriage a letter from a friend who lives in another country is valid?. A letter from my catholic priest talking abbout when i talk about a marriage counseling would be valid for evidence of bonafide of marriage? I dont have friends or family here except my husband's . evidently i can't ask them for a letter. My name is not in the lease bank account nor insuarance or bills.. Nothing!

No, my 1ts EAD receipt was C09, the 2nd EAD is C31. After receiving EAD C31 in over 2 months i have received Vawa approved notice.

I think my case is different because I received two receipt with C31 category on both, No receipt with C09 category.

As you said to another person here, is the IO who has the dicretion to send RFE. under this circunstance where i dont share any bills or nothing even taxes with him should i wait to receive a RFE. Or if you consider this letters important and valid should i send it immediately now that my prima facie just got approved?

Thank you, I pray that you will get some closure soon and be able to see your family soon. I know the feeling of longing, where you just want to see and spend time with your family. Be strong, I hope this happens very soon.

What forms did you file for your VAWA? Did you submit another I-485 and/or I-765?

If you had work permit from marriage based petition, what happened to your EAD card? 

 

 

Thank You! My Attorney only filed I-360 and selected the option to get EAD on Approval. My I-485 based on marriage was held, so I did not have to file another one. I kept and renewed the EAD that I had received based on the I-485. However, when my I-360 was approved, I received another EAD under C31.

Good luck. Just go in there confident, be courteous, professional and most importantly BE PREPARED. Have all your documents organized, and separated. Bring Original and Copies of important documents. Birth Certificate, Marriage Cert, Divorce (if applicable), any EAD or AP you have. I94, Current and any previous passports and make note of all changes such as job/addresses since you filed the I-485 and advise the officer. I pray that you get an instant or same day approval as well.
