Hello everyone,

Hi @sandranj

Please can someone guide me what will I do if my husband’s lawyer write a letter to USCIS to deny my VAWA case?

I filed a protection order against my husband but the Judge denied the order due lack of evidence. I only had written declaration from me and family regarding domestic violence. He has a lawyer to defend him. My husband’s lawyer knew that I am applying for VAWA.

Thank you so much.

The VAWA Unit will not take anything into consideration that isn’t sent by you. They are aware of the fact that when abusers learn about their spouses filing for VAWA that they will try to lie and defend themselves. Don’t worry, just block your ex’s number and social media and make sure he can’t contact you. You have nothing to worry about on his side. USCIS will not consider what he or his lawyer have to say. They don’t even have your A number or case number either. They just want to scare you, which is continued abuse.

In his written declaration filed in the court, he said that I just filed this protection order because I am doing a self-petition and because I am currently overstayed. His lawyer will probably send this court denial letter to USCIS and request to deny my case.

I just got I-797 but still no prima facie.

I appreciate your response @Gogetter18

@Charlotte18 I'm so sorry that you are going through that. I can relate because my ex husband whom I was with for 16 years and have children with did the same to me, his lawyer kept bringing it up in court, but thankfully it didn't fly with the judge, cos who would be married for 16 years with children just for papers? People are just cruel, it's sad but that's how some are.

Again, USCIS officers that process VAWA cases are not supposed to take anything your abuser says into consideration at all, so he can file whatever he wants to in court, it will not help him. My ex-husband and his lawyer called USCIS last month to inquire about my case since he withdrew his petition for me (the mother of his children), and they were met with a brick wall, not only did USCIS refuse to give them ANY information, USCIS wrote to my attorney's office telling them that a third party was trying to get access to my case, I have the letter with me.

I truly hope you get a prima facie soon so you can get some public benefits while your case is pending.

Al the best 🙂

@llo i used my prima facie to receive financial aid but had difficulty at first as well. I then received two other documentation from my lawyer which I then submitted to them and my financial aid was approved. I will send these to you when I get home. Please remind me.

Hence i would suggest sending the prima facie with the VAWA approval.

Hey guys. I have a question about the medical form. My I-360 card went into production on October 12th and the approval letter came October 30th for my VAWA.

I need to get a new medical I-693 for the interview, does anyone know what the policy update of Nov 1st means? It says it needs to be signed 60 days before filing the underlying petition, but my I-485 has been with the local office while my VAWA was pending. Does that mean I shouldn’t do the medical until 60 days before the interview?

Hi Folks. Let me explain something here about the RFE. USCIS will issue RFE  if the officer wants more proof of the abuse and/or bonafide marriage. It's not mandatory that the IO issues the RFE. USCIS decision is discretionary. But if someone forgets to submit documents that are mandatory when filing AOS/VAWA they will deny without issuing RFE, documents such as a copy of birth certificate, copy of marriage certificate, divorce decree, if any, etc.

I have the same issue on here. I was issued rfe for GMC, which I sent. The received and updated on Nov 9th. Then I created an account on USCIS website, when I log in. It shows on the timeline that they issued on Nov 19th an rfe for additional evidence. But till today my lawyers haven't received any mail from them. At same time  it shows we received your rfe on the 9th and we will start working on it again when I checked just online with the recipe number. I'm so confused.😔. Till today no prima facie. Is been 19 months that I filled.

I would honestly suggest to do the medical once you receive the update that your interview has been scheduled. I suggest you get all vaccines that you may still need from your primary care physician beforehand, so that your insurance covers it and then just go to the medical for the few tests that are necessary. If your local office takes a long time, you don’t want your medical to expire.

1. If you want prima facie, you can simply have your attorney write a letter to VSC to request it. Your attorney could have done that a long time ago.

2. Online updates are not reliable. Don’t be confused, it is likely that USCIS just put in something wrong. Only rely on the actual letters you receive from them.

3. If they received your RFE response on 11/9, you should hear within 60 days but keep in mind that Thanksgiving and Christmas may delay things as officers might take some vacation time.

Hello everyone , I have videos and recorded phone conversations that

clearly show physical and emotional abuse , how can I submit this evidence if USCIS only accept paperwork , no CDs or anything like that , and did someone ever had this experience ?  Thank you

Find a place where you can get audio transcription . You can’t submit video but you can show the video to someone and the person can give you an affidavit stating what he/she watched, notarized affidavit with name place and date of birth phone number and address. When and where this person met you etc.
