Hey everyone

I applied for VAWA in August this year, filed for i360 and also for combo card. 

Two weeks ago I received my prima facie letter and my question to all of you is when will I be getting my EAD and travel document?

 

Also, is it possible to apply for a health insurave somehow with prime facie letter?

The psychological evaluation will be enough to prove abuse if the evalaution has the  abuse  told in details ,and if you have a diagnose of depression and/or PTSD due to the abuse suffered.

If VAWA won't be reauthorized on December 7 2018 USCIS will continue adjudicating  all   cases received before December 7,2018.

It's not mandatory to submit affidavits stating about the abuse,  but it helps to prove abuse if the affiants  specify  details of the abuse suffered.

File a new I-765 just when they deny the previous AOS. Until now your previous AOS is still pending then your EAD is still valid.

@xoxox On page 11, the sub-section says: Appeals/Motions, they were asked different questions in regards to whether anything can be done to avoid a denial and a subsequent NTA. Generally, you cannot appeal anything unless your case has been denied. Your case has to be adjudicated first, if it is denied, then you file a motion to appeal that denial with proof of why they should reopen your case if it is possible to do so. Question 32 specifically asks if USCIS will issue RFEs and NOIDs to the petitioner giving the petitioner time to respond with more evidence before denying their application which may lead to an NTA. The reason for issuing RFEs and NOIDs is to give the petitioners additional opportunities to prove their case and hopefully get them an approval instead of a denial. An NTA is only issued in the case of a denial and where the petitioner is deemed to be out of status, inadmissible, etc.

Please read over the whole pdf, it is only 16 pages, it is well worth the read 🙂

@monoxidelullaby Hi. Quick question: did you apply for your I-485 (AOS) concurrently with your I-360 and I-765 combo card? If so, then normal processing times for EAD (C9) are about 3-5 months, but if if you did not file your I-485 then you will have to wait till your I-360 is approved to receive your I-765 (C31)

@monoxidelullaby yes you can apply for Medicaid with your prima facie, just submit your I-797 NOA along with your prima facie and your application, and normally it takes HHS 30 - 45 days to process your application.

11/08 After the interview officer did not tell me right then but said "we need to review your case, if you don't hear in 120 days you may call us" I left thinking I may be stuck for months, a couple of hours later I received the text/online update (New Card Is Being Produced).

11/09 The next day they remembered to update the next day to (case approved)  after the card lol

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/17/2018 I-360 online Update (correspondence received)

12/25/2016 Notice for Biometrics

01/12/2017 Biometrics completed

01/31/2017 EAD update (Ordered my new card)

02/04/2017 My first EAD delivered.

02/06/2017 Picked my EAD & applied for SSN

That's Extremely Good News .. So USCIS still sending RFE for all types Cases or applications for any applicant summited his/her case after September 11 instead of they just denied the case without sending RFE .. Thanks for clarification this Matter .
