I dont think there is anything Sandra can say. She does post relevant links and info from official sources as they occur. If she is withholding her personal opinion (for now) its probably because she is still monitoring the situation. I have no doubt that Sandra truly cares for everyone on this thread and gives honest and accurate advice with their best interests in mind. If she feels there is an urgent need for people to rush to file- I believe she will state so when its appropriate. Just hang in there and keep checking the thread for any updates she may post. Also remember the VAWA act covers more then just 360 self petitioning for immigrants. Its a multi page piece of legislation that deals with various kinds of sexual abuse, child abuse, dating violence, restraining orders, stalking etc. Many programs and services get money under this and many organizations are fighting hard to ensure the program is not only kept but strengthened. 

Personally I do not believe the entire VAWA act will be scrapped- there may be changes; some proposals may not be approved ( I think theres mention of trying to get something in about stripping gun rights for perpetrators? that might not get approved) but I think in general most people do not view DACA immigration or illegal immigration issues the same as domestic violence issues for immigrants. It is easy for people to take a anti-immigrant POV and support policies to reduce or prevent immigration paths but rarely will you find someone who is anti-domestic violence laws that protect women and children  including those who are immigrants.

I wrote my representatives and have also used twitter to express my views and urge everyone to do the same. My representatives had a link on their webpage to email as Im sure most do. Here is a link to find your local reps and a general link about how to mail paper letters to the capital or where to call. Remember you do not have to be a citizen to have your voice heard. They represent the people in their district- that means all people that live there, has nothing to do with your immigration status.

He just messed up your case filing a new l485. USCIS will deny your previous l485 now because he filed a new one, once the previous AOS is denied your EAD will be null and void,it’s just  unbelievable .

Wow, this means that I have to do another finger print and apply for another work permit and wait to receive my EAD card, am I right?

He just messed up your case filing a new l485. USCIS will deny your previous l485 now because he filed a new one, once the previous AOS is denied your EAD will be null and void,it’s just  unbelievable .

My attorney believes that my AOS is not valid anymore because it was based on my I-130, which by filling divorces automatically cancels. 

Thus, we applied for a new I-485 with my I-360 (Concurrently). 

 

Is it a possibility, that USCIS reject my new I-485, since I already have a pending I-485?

As i said before you EAD just becomes null and void if the AOS is denied. Filing for divorce has nothing  to do with canceling your AOS, your attorney really needs to study about VAWA Law.They will no reject the new AOS but they must deny the first AOS because you just filed a new one, and then your EAD will be null and void.

The mental health professional who will perform the psychological test and evaluation must be  a  certified  psychologist or  counselor.

In order to have a work permit, should I file new I-765, based on new filled I-485?

It’s good that way ..was just asking if you have anything to say about the reauthorization if it’s gonna affect the new vawa filers ..cause December 7 is almost near and they haven’t been talking about the renewal ...that’s why am asking if you have any information about the vawa if we could still file for vawa after December 7 even if they fail to reauthorize it ...

so it doesn't really matter if my current counselor doesn't have a masters degree yet? besides proof that I have been attending counseling sessions, I need a psychological test and evaluation? so I need these two things? thanks

It happened to me too. I asked my lawyer she said vawa is a law. Long process..If uscis won’t accept vawa applications after Dec7 anymore, Uscis should be announced by now . They won’t just stop it with out any announcements.. right?

@MariFD Please do not listen to some naysayers about VAWA not being re-authorized, just concentrate on gathering all your facts (proof of everything from your courtship, marriage and the abuse), evidence of co-mingling, psych evaluations, affidavits, yours and other witnesses, and then go through the check list with your attorney if you have one to ensure you have eberything, then pray and submit your application.

Please read sandranj's post on page 182, she shared a link on a recent teleconference that was held by USCIS, that should help answer some questions you may have, especially about RFEs. And to be honest, laws aren't scrapped completely overnight, it takes time to implement or change laws so please do not allow other people's negative comments about re-authorization scare or distract you.
