I am hopeful they won't stop VAWA, they have been talking about for a few years but they always renew it, fingers crossed! It is important to all people that suffered Domestic Abused to seek medical help to stay strong!

Let’s wait and see..though it won’t affect those that have applied but for those that are about to apply we are not sure of ... madam anything could happen in trump regime..he stopped DACA program and daca program is even more pitiful than vawa so let’s wait and see what’s gonna happen December 7...I am now begging my wife more now but she’s still hurting me and sometimes she slaps me ,she still locked me out side the house on Sunday I slept train station is just so pity that’s its when I need this stuff that’s when this issue of reauthorization is happening if worst comes to worst I take my wife to interview like that cause I Dnt know the meaning reauthorization that they are talking about smh

Did you applied alredady? make sure to have all evidence in hand. I went through it before I know how hard it must be!!! Move out to start  better life of your own, Best Luck!

The problem is that I haven’t applied yet and nobody knows what they gonna do about the reauthorization of vawa...can’t wait till December to hear and see what’s gonna happen I know trump is very unpredictable when he comes to cases like this he might stop the vawa the crazy thing about it is that the republicans are not in support of it lets wait and see

Before filling for VAWA, I filed concurrently for my green card through marriage (U.S. Citizen) and my priority date is in January 2018. I received my EAD card in June 2018 and is valid for almost a year. As of today, this case status is "Ready to be scheduled for interview"; however, I have filed for divorce after domestic violence accident. 

My question is regarding my work permit.

 

Is my work permit still valid? 

 

 

Your work permit is still valid. As far i understood you filed AOS when were still living with your wife, why did your attorney file a new AOS?

@sandranj thank you so much for posting this update, it helped to answer so many questions that many people have asked on here. Answer 32 also states that RFEs will still be issued if needed, so that's good to hear.

Thank you for your reply. 

My attorney says, since I have filed for divorce and I am not living with my husband anymore, my AOS (old filed AOS in January 2018) is not valid anymore; therefore, she filed a new I-485 with my I-360. 

What happens to my work permit, if I go to the interview without my husband (old filed AOS in January 2018), and tell the officer that I have filed for divorce and I filed for VAWA?

OR

in order words, till when is my work permit valid (expiry date on the card, or the interview date)?

 

Per your response, since my work permit is valid, I don't need to apply for work permit anymore, and I just need to renew it when the time comes, based on my VAWA file, am I right?

 

does filing another i-485 make conflict in my USCIS case?

Your questions are very good, I think Sandra can help us understand better.
What I understand is that USCIS will send NTA to applications (I-485, etc.) that are denied as of October 1, so it will not send requests that were denied before October 1. I also understand that it specifies that Officers may also exercise discretion to apply the 2018 NTA PM to cases denied prior to June 28, 2018, if those cases are being reviewed for cause or substantive reasons.
What I would like Sandra to help me understand is what they mean when they say "if those cases are being reviewed for cause or substantive reasons.".
In another part of the document it also indicates that USCIS reserves the right to send an NTA as long as it considers it appropriate.

Clearly your attorney doesn’t know anything about Vawa,I wonder how he managed your Vawa case since he doesn’t know about Vawa, of course the previous l485 was valid.

 

He just messed up your case filing a new l485. USCIS will deny your previous l485 now because he filed a new one, once the previous AOS is denied your EAD will be null and void,it’s just  unbelievable .
