Timeline

I had my i485 interview at Sat Francisco office today. Officer asked me so many questions and she even went into many details related to VAWA. Asking all the details about the abuse. I was feeling uncomfortable but I still managed to give a summary. Later she handed me a paper saying my case is going to be on review and they will get back. I asked how long does this review take, she said about a month. I didn’t take my attorney with me. The officer asked me to sign some where, where it said I am waiving my attorney, not sure if its good or bad. 

 

Any one have any similar experience. Does anyone know how long this additional review is going to take. Also, my interview lasted for over an hour.

you can not do anything but waiting, stay strong and hope for the best! wish you all the luck!

 

I recommend for future interviews is that everyone invest in an attorney it can cost about 500$ to go with you to the interview, because they should not be asking you about the abuse since it has been already decided on and approved by the VAWA unit. an immigration attorney told me if the officer asks about vawa during a GC interview to politely stop them since the vawa is already approved.

Stay focous, I know it is very hard 😖 I am from VSC May 2017 filler, my WP just arrive after 18 months waiting... cheer up!

Hi Sandranj

 

Today I have received receipt for my VAWA application but they have denied my fee waiver request for I-485 and they have returned I-485 and I-765. I don't have job right now  and I can't afford to pay fees for I-765 and I-485. Currently one of my close friend financially supporting me as I can't work unlawfully. 

How can I request fee waiver one more time ? Do I need to submit any specific documents like an affidavit about my financial situation and an affidavit from my friend that he is supporting me financially to take care of my living expenses ? I am under so much stress as I don't know how can i would afford fees for I-485 and I-765, I really don't have enough money to pay the fees☹️. Please guide me how to handle this issue? Looking forward for our reply. Thanks.

when my probono attorney filed for VAWA in August last year he told me that I will not be able to work until VAWA gets approved and when I told him that I can apply for EAD under C9 he refused saying that USCIS will not approve it. and he told me if I decided to apply then he will not represent me anymore, I ended his representation and informed USCIS and then filed for EAD under i485 c9.

 

on my VAWA application my attorney checked item #12 (please see attached picture) I don't know if this is way my EAD is taking time it says that if #12 is checked then EAD will only be issued after VAWA approval. 

any suggestions, any advice I am panicked I don't know what am I going to do with no income!

Mine took 18 months to get approved,

I filed under C31 on May/25/2017, it just got approved on Oct/29/2018, stay strong and be patient Vermont Center works the slowest!!!!

It is normal procedure to sign a waiver when you attend an interview without a legal representative.... It's merely to state that you agree to be interviewed alone!

It is also normal to be given a paper stating that your case will be reviewed, it can be an instant approval or within few days or can take up to 4-6 months in very few situations.

Sometimes officers cross the line questioning the VAWA specially if there is no lawyer present to stop them  in their tracks, but the applicant may also state that it has already been adjudicated at VSC if it gets too uncomfortable or invasive (I hope it wasn't that bad for you) , but generally there is no harm in giving truthful answers if it doesn't cause you severe anxiety to do so.

12/14/2016 Date on the NOA

Yes, and you dont need to wait for a prima facie. All you need is any document from your i360 case that carries your alien number on the document. I took it to Dps and the worker didn't know anything abt it and asked me to leave because I presented just my old WP that had expired since April this year. I asked him to process it like that and he wrote to immigration to verify my lawfully presence in the US. Two weeks after USCIS sent me a letter saying based on my expired working permit and vawa although still pending ( with no prima facie yet) I usually for a this benefit and that I'm lawfully present in the US. A DL was issued to me and it issued for a year validity. I live in Texas. Goodluck.

hello Yollande, what documents did you use and what did you tell them? could you please explain more, I have been without a DL since my EAD expired last year, and they told me that I can not use the prima facia to renew! I live in California

If you received the first EAD category C9 then you don't have to pay to renew the EAD using same category.

Submit your bank statement,if you have tax return submit a copy as well. Submit bills that you have to pay montly and ask your friend to mention  your name and address and mention that you are unemployed and he/she is providing you room and board .Ask the person to put date and place of birth, current address and phone number and notarize the letter.

You are right, some IO are almost forced to re adjundicate Vawa when the applicant appears alone for an interview, with the presence of a lawyer, they know they have a limit on what to ask.I would definitely get a lawyer to go with me when I finally gets my interview date.
