If the person can’t afford  to pay then the person can file form l912.

@sandra I am not trying to argue with you, I just want to make sure we are all cleared on this, pthease also read this article were is says " what if i have already submitted for I-485"

Someone should please help me interpret this.

 

What if I’m submitting (or have already submitted) Form I-485?

If you’re planning on submitting Form I-485(Application to Register Permanent Residence or Adjust Status) and its associated filing fee, you don’t have to pay an additional filing fee for Form I-765. You can submit both forms at the same time with just the filing fee for Form I-485.

If you’ve already submitted your Form I-485, you can still submit Form I-765 without having to pay the filing fee. In order to qualify, you need to have submitted your Form I-485 on or after July 30, 2007, along with its filing fee. After submitting Form I-485, you should have received a Form I-797C, Notice of Action. This Notice of Action is basically a receipt that tells you that USCIS has received your Form I-485 and is processing it. If you include a copy of this Notice of Action with your Form I-765 when you submit it, you won’t have to pay the filing fee.

This is not an official government website. Please be careful and don’t trust things on websites that don’t end in .gov

Yes I understand but it is the same thing written on the uscis instruction, please if you can help me review the instructions for I-765 were it says who is exempted from paying the fee, I need to be sure I have the right information.

@iwillsurvive, I copied this directly from the I-765 instruction  form (page 23) on uscis website, under initial filling, please interpret this for me because I have someone who needs to know aswell. Thank you!

 

12. (c)(9) or (c)(16) Any current Adjustment of Status or Registry applicant who filed Form I-485 on or after July 30, 2007, and paid the appropriate Form I-485 filing fee. If you file Form I-765 separately from your Form I-485, you must also submit a copy of your Form I-797C Notice for Form I-485, as evidence of filing Form I-485 on or after July 30, 2007, and payment of the appropriate filing fee. If you did not pay the appropriate Form I-485 filing fee because your filing fee was waived or you are exempt from paying it, you must pay the Form I-765 filing fee or request that the filing fee be waived;

I read the instructions and I'm waiting for some feed back here in this thread, because I think that I might misinterpret it.

The plain language leads me to conclude, that if you paid the I485 fee you should submit proof via the I79C AND THE APPROPRIATE FILING FEE (for the I-765) If you got a waiver for I-485, that waiver does NOT automatically carry over to the I-765, you will be required to do one of two things, pay the fee or submit a second waiver for the I-765. (This has also been my personal experience) However, when you are renewing, you WILL NOT be required to pay the fee again providing that you ARE renewing under the same category.

hello @sandranj and @iwillsurvive please i need ur help.So i filed for my green card in october 2018 after my vawa was approved in july 2018.So my priority date was august 2016 so i was told i could only file green card when it’s current which was in october 2018.So please i check on the processing time line and it says they are working on october 2016 cases,so when can i expect to receive an interview notice?please just estimate and tell me so that i can start putting my things together.thanks alot!
