During this time I filed for i-360 (November 2017). 

My question is if they approve my i360, will I need to refile the i-485 with the court or will they process the i-485 that was filed in 2016 with the approved i-130?

 

You can use the I-485 and once the I-360 is approved your attorney will request  that the adjustament of status interview be conducted based on the approved i-360.Once your VAWA is approved you can choose to adjust status with the Immigration Court or file a joint motion to terminate the removal, it was denied before  because your VAWA is not approved.

@ Anna2018, You can do Theraphy for free but it depend on your state

Hi everyone! 

Hope you having a great summer. 

I am successful VAWA case and today I had the interview for citizenship. 

I did great on the history test ( answered all questions) also passed the writing and speaking test.

However the officer was asking me again about my marriage and few details about it. 

Is this normal? I did not expect to be questioned again. I have nothing to hide, and I gave the answers, however he was asking me dates and I have forgot some since my marriage was 6 years ago. 

The officer was a male and he wasnt really nice, but very formal which is OK but makes me thinking he is strict and can do something about my aplication. 

 

He said a decision will be made in 4-6 weeks. I thought this is a formal interview and now I am confused. 

Please if someone has passed interview recently share your experience with me.

VAWA : Have anyone waiting after I-485 interview after VAWA approval?

I had my interview in November 2017, and after that I was told I will hear back in 90 days. Heard back nothing, have done atleast 10 infopass apts, I got told case was under the extended review. I went to Infopass three months ago,  this time I get told case is at the last stage with the immigration officer to adjudicate. Currently, 9 months have passed and still nothing. I am in touch with congresswoman who is helping me. Went to Senator, which was of no help. I reached out to Ombudsman, and got told it is taking 120 business days to look into case, before it was 45 business days.

 

Is anybody in the same situation as mine? Any thoughts/ suggestions, much appreciated. I just wrote to Sandraj as well.

If you can't find your I-94 online, write a notarized letter stating your name,date, and place of birth. Explain in detail from where, where you came into the U.S, when did you your arrived and in what airport you arrived,mention your  passport number(the one you entered in the U.S). Declare where you were admitted into the U.S . and explain why you don't have the I-94.


Use this declaration:
 I declare under penalty of perjury (under the laws of the United States of America) that the foregoing is true and correct.

When your VAWA is approved you need to ask USCIS counsel to join you in the petition to ask the Court to terminate the removal proceddings, and he will once the VAWA is approved . When the removal  is terminated then you can  file I-485 with USCIS and adjust status with USCIS. In case he doesn't want to terminate  the removal proceedings after VAWA approval(never saw one single case like this) then you can adjust the status with the Immigration Court.

 

99% of the VAWA cases are approved with deferred action,deferred action means they CANNOT DEPORT YOU until final decision in your adjustament of status. Anna I will help you to file VAWA without charging you,but I will not represent you,it means I can review your affidavit,evaluation and filing form I-360 and you can sign your own I-360. I WILL NOT BE YOUR ATTORNEY! But  when VAWA is approved then you should find some attorney with experience in removal to help you with the removal. For everything that you told here i believe you have a VAWA case,but you need to have a GOOD psychological evaluation,if your evaluation is not good then I won't be able to help you because is very important the psychologist drafts a GREAT evaluation and not a 2/3 pages with some generic information.

My lawyer submitted the I-360 with an evaluation of a therapist that I had attended 5 times during my marriage, the letter is 2 pages and could be said to be a general evaluation, not very solid.
USCIS requested an RFE of good moral character a month after sending the I-360. I would like to know if I can send along with the RFE response of good moral character a second better psychological evaluation, since according to the new USCIS norms, in case some evidence of abuse is missing, it is likely that they will not request new RFEs and proceed to deny the case.
I would like to know what you think about this and please explain to me what you mean by a detailed evaluation.

I guess not, you have waited for so long adjustment will be not long just wait after getting your gc then you can get married.

That's my second ead renewal

 

July 2,  received at Vermont.

 

July 15, no fingerprints required old one to be used.

 

August 5, we ordered your new card.

If you have an attorney HE/SHE SUBMITS documents to Uscis,not you. The RFE is for good moral character, to submit additional documents you need to submit additional a copy of the l360 receipt along with the evaluation,your attorney should know how to submit additional doccuments.

Legally speaking you can,but I saw 3 members of visa journey that got married after vawa approval,they had the AOS interviews  and two cases the local office submitted for revokation,two years ago, and Vermont didn’t deny yet but they didn’t affirmed the approval either.

 

Make sure you take your time dating. I saw MANY cases of VAWA  petitioners that got married after dating for  just a few months and they were battered again. Pay attention to the red flags such as you didnt  meet his/her family yet, he/she doesn’t get along with his/her family,he changed jobs quite often, extreme jealousy,propose too fast,refuses to socialize/meet your friends,yelling,calling you names, kicking wall and doors when angry etc.

Usually they take 10 days after vawa approval.

 

The work  permit is taking 90 days to be approved.
