The lawyer did the form 912 and a letter, explaining that I don't have access to my husband income and the income is below of the line of poverty.other than that nothing else

I don’t understand why your attorney made reference to your husband income, filing a waiver has anything to do with your husband income but with your income and if you don’t have one he just need to prove this, and if you are in the tax return of your husband you can have access to the tax return using the IRS website.

Unfortunately, my lawyer isn’t very knowledgeable about VAWA and couldn’t give me the information I need 😔 She sent my EAD renewal under my I485 before sending my I360 which is a month after. Do you think that will delay my EAD/AP? It’s has only been 69 days. @sandranj

Yes it will delay your EAD.

So I have a situation after my I-360 was approved my I-485 was transferred as follows:

  1. from VSC to NBC
  2. Then NBC to NYC Local Office
  3. Now from NYC Local Office to St. Albans Local office.

I live in Manhattan NY, any reason they would transfer to an out of state local office for processing? I did call USCIS and even though they were being really strict in talking about my case over the phone, asking me to write to the VAWA Unit at VSC the person transferred me to L2 office who explained that it was done for faster processing but I never received a notice. Checking the processing time for St. Albans my receipt date is two months past the current month they processing.

Anyone with similar experience?

Uscis usually  return   the file to VSC after approval just to be revoked.

Did you get married before Vawa approval? Do you have any misrepresentation in your case ?

Hi Sandra,

I am still married to the Abuser. everything I submitted was hard evidence; police records, court records, medical records, pictures, sworn statement from myself and police clearance certificates... The communication I got was its at the local office and not the service center in Vermont.

I wrote to the service center for clarification and waiting for a response.
