Hello all, i need advice how I can turn this situtaion to become a  blessing for my case.

I signed the lease for where i lived with my spouse, because she had eviction issues she cannot lease by herself. So i added her to the lease.

When the abuse got to the peak I left the apartment in June. She stayed there with all of her friends and family. But,I still paid the rent till August 2018 when the lease expired. She refused to leave the apartment, and she is not paying for rent pr any of the untilities bills in our names.

Now the apartment has gone to eviction against me since I am the principal on the lease. I contacted a Pro Bono to help responded to the eviction notice from the Superior court. 

It was stated in the respons that I am an abused spouse and I 1let the apartment since end of June, yet i paid the rent till the lease expired. Lease agreement and receipt of rent payment for 12 months was attached to the response.

The prosecuting attorney called me and said he appreciate my position and I have done the right thing,I should not be a victim further.

The attorney added the case will still go to court, where he will ask for forceful eviction of my spouse and her people and also ask that the judgment be cealed, so that it will not enter into my record.

How can this play in my favour and also add to proof how cruel my spouse was to me.

The Law states the abuse to be considered should happen WHEN YOU ARE LIVING WITH YOUR SPOUSE, that being said the eviction won’t have any benefit in your Vawa case first because it happened when you were not living with her and second the refusal to leave the apartment and eviction are not considered abuse for immigration.

Your attorney needs to learn about Vawa.NBC will forward you case to  VSC, it will take a while for NBC to ship to Vermont.

You can change the address online now because you are a green card holder.

Unfortunately, my lawyer isn’t very knowledgeable about VAWA and couldn’t give me the information I need 😔 She sent my EAD renewal under my I485 before sending my I360 which is a month after. Do you think that will delay my EAD/AP? It’s has only been 69 days. @sandranj

No need to worry! I had never gotten an update on my I-360 either after the initial “we received your petition and the fees were waived”. Then one day (16 months later) I received the next update. 

They are working on June 2017 currently. Your case is perfectly normal and within processing times.

The lawyer did the form 912 and a letter, explaining that I don't have access to my husband income and the income is below of the line of poverty.other than that nothing else

Did your attorney submit one of your pay stubs as proof that your income is below the poverty line? 

 

Work with your attorney to collect proof of what you claimed on the fee waiver. That should work. They just need to see evidence.

Hello everyboby. I hope all of you are doing well.

Pls help me: My case is approved and now being at the local office. I just have received the additional evidence to complete I-693 because i didn't submit with vawa. But USCIS said that i donot need to submit now, othewise will take it into interview appoiment, submiting it now will delay my case..

Can you guess how long would i get the interview notice after getting this notice for I-693?

Have any person got the same experience? Thank you so much for any your reply.

This completely depends on what timeframe of applications your local office is working on right now. If you want to know more you can always make an InfoPass appointment. Depending on the I-485 processing times at your local office (if less than 12 months), you could get the medical done now. But it all depends on how far along your local office is
