She has to submit a new I-765 category C9, because the I-765 will be submitted after form-485  then you need to pay the USCIS fees,your attorney screwed up big time, but if you can't afford the USCIS fees than she can submit the I-912  to waive the fees. Clearly she doesn't know anythign about VAWA the, tell her that you have to pay the fees or to submit the I-912.

Another bad attorney. She filed with wrong category,  you will get work permit after VAWA approval using category C31, it's taking 16/20months. You filed AOS then she has to file form I-765 category C 9 and within 3 months you should receive the work permit. Because you will submit form I-765 after filing I-485 YOU have to pay the USCIS fees or to submit the I-912 to waive the fees.

Hi Sandra,
kindly advise me.
I have advance parole gotten with my EAD CO9. Still very active.
Is it advisable to travel out of the US with it, while no action has being taking on my i360?

Vermont transfers your I-485 to th National Benefits Center who then looks over the forms to make sure everything is filled in and then they transfer it to your local office who then adjudicates it and schedules your interview.

Hi, can I ask you a question  please, did you file i485 for your kids as derivative beneficiary of your vawa?

I have the same concern with yours. I don't know if we can file I824 for abroad children after approval vawa with I485 pending? What is going on for this step for children to get visa?

My attorney did the same with yours . She said I will get my EAD with c31 in couple months after biometrics appointment.

I asked her apply 765 with C9 for me so many times, but she said no always , then finally she said I can apply ead with C9 after she talked with her supervisor , but she said just leave my pervious I 765  there it would be okay ,which she applied with c31 . So she is going to apply i765 with C9 while pervious I765 is pending .

   then I hear from Sandranj need to close the pervious I765, also I can apply for my minor children while my VAWA is pending, but my attorney  does not do it and told me that I am not eligible to apply it for my children.  

   So I ended contract with her and sent all applications at once by my self , but I did not wrote letter to USCIS and ask USCIS to take off her information from my cases  yet.  

   Does USCIS will reject my cases because I did not sent letter to tell them I don't have  attorney any more ?

 

 

   Any one here have example with the letter to end contract with attorney? Share with me please.

I never told you that she has to close the I-765 category C31.I said she filed with wrong category and she has to file category C 9.Category C31 is just issued after VAWA approval.

Many people travelled with AP and reentered without any problem, but AP does not guarantee reentry.

You can file the I-824 along with your I-485,or after your I-485 approval, but NVC will forward  to the U.S Consulate the form I-824 just after your green card is approved. I prefer to file form I-824 with USCIS after the AOS approval because I saw many cases that USCIS forgot  that the I-824 was submitted and they didn't ship the file to the Consulate and people were waiting for several months and found out that USCIS didn't even initiate the I-824 process.
