My vawa attorney alway said it is doesn’t matter, he said because I ha e “notice of dismissed “, he is not very professional,  last time mar-2018 he have submit my I-485 to Uscis , Uscis return all document . He was submit 2nd time Uscis accept it .i am not very true his suggest  for mysel criminal history record .

Certified Court deposition is not the same thing of a dismissal notice. The dismissal notice states that the case was dismissed, that is it,but the Court deposition creates a written transcript of your testimony,and you need to get a CERTIFIED DEPOSITION.People think the dismissal is what matters but for immigration what matters besides the sentence is what the parts said in Court.

 

 

I think It’s a fair attorney fee $900

Hello,
I am new to this forum, I do not know much about Vawa, but I have read and apparently there are many collaborators that may be able to help me with this situation that worries me:
After archiving my complete package (I-360, I-485, I-765), I recently noticed that my attorney apparently mistakenly sent Form I-765 under category C31 instead of category C09, so that I will not get my work permit before my I-360 is approved. Before asking my lawyer to explain how she could correct this error, I would like to know how it might be possible to make such a correction, either by sending a new Form I-765 under the category C09 or in some other way possible.

Once Vawa is approved your attorney has two options,a) ask the Uscis counsel to join the notion to terminate proceedings and then adjust status with USCIS, b) file a motion to reopen and adjust status with the Court.  Most attorneys prefer option “a”.

Thank you so much for your reply. Do I need my I 94 and my passport with my original visa when I file for motion to terminate proceedings? 

 

We had a fire at my uncles house back in 2010 and my passport that had my visa and I 94 was burned. I have a valid passport now but no I 94. I just want to know so that I can start gathering everything I need so when the time comes, I will be prepared. Thank you again for your response

You can ask your attorney to submit I-765 category C9 and to also send a letter to withdraw the previous I-765 C31. 

You have to pay the filing fees unless you qualify for a fee waiver, then I suggest you send the fee waiver along with the I-765 C9.

My attorney filed VAWA petition for me including; I-360, I-485 and I-765 few days back. As she has filed I-765 under C-31 category, when should I expect to receive EAD card ? My attorney said, I will receive it in 3-4 months after biometrics appointment. In this thread I found, EAD card only get issued if I-360 will be approved in C-31 category. Is this true ? Thanks in advance !!!

@Angelica123 The same happened to me so my attorney resend a new one two weeks ago with category c09 and explaining to USCIS that she “mistakenly” filed under c31. Even though c31 is a valid category, she just wanted to explain that I wish to receive my EAD now and not after the I-360 has been approved. She also included the fee waiver and ask them to disregard the form send with c31 category.

 

However I still have not received a receipt notice from uscis yet.

@shayona by choosing cat. C31, your I-765 will only be approved after your I-360 has been approved which can take up to 24 months. If you needed to receive your work permit in 3-4 months, your attorney should have filed cat. C09

My case was filing the same yours on CAT C31 together I131, I485, but my 1st EAD issued C09 after over 90 days filing.

The 2nd EAD is issued C31 along my case is approved. I have my lawyer for filing.

Yeap, My lawyer filed I-360 with I-485, I-765, I-131 for me. My 1st EAD is combo card (EAD and Patrole Entry) on C09 unless my Lawyer chose C31 on I-360.

Still I am confused a little bit. Did your lawyer choose C-31 or C-09 category while filing VAWA ?

My lawyer filed C-09 category while filling my Vawa.

But everybody in this forum say we have to file C-09 for getting earlier than C31. Being careful is the best for our case.

Thanks for quick reply :) I think because of choosing C-09 category you might have received EAD super quick. 

Hope someone in this thread share personal experience if she might have filed VAWA under C-31.
