You're welcome. Just don't give up. Carry on calling etc. It's all rather overwhelming but it does get easier

You need to have a psychological evaluation done if you don't have a police report.

You can appeal a denial decision, but just 1% is granted. You have the alternative to refile again the I-360.

ICE uses a system called Central Index System (CIS)  to flag the victims of domestic violence, when they see the flag they know they can use or not the prosecutorial decision. In case of removal, you can ask ICE to use PROSECUTORIAL DISCRETION. In 2011 USCIS issued a memorandum about to refer or not an alien to immigration Court, despite the memorandum does not specify specific VAWA petitioner, ICE sometimes uses the  prosecutorial discretion in VAWA cases as well. They have the authority to issue, serve or cancel a Notice to Appear, to detain and release on bond someone.

If you can't find your I-94 online, write a notarized letter stating your name,date, and place of birth. Explain in detail from where, where you came into the U.S, when did you your arrived and in what airport you arrived,mention your  passport number(the one you entered in the U.S). Declare where you were admitted into the U.S . and explain why you don't have the I-94.

if the report  mentions the abuse in detail, onset of the problems, your background, tests performed,diagnose then you should be fine,but if it's just a report stating you attended counseling there  then this kind of report has no weight  whatsoever in a  VAWA case.

Hi Sandra. I'm January, 2017 filler (360). Any idea why my case is taking so long? Do you have any January, 2017 pending cases? Is there any chance that they lost my form?

It is not dependent on the biometrics appointment. Current processing times are 4-6 months from your receipt date at VSC if you filed under category C9.

All my casos filed between Jan and March 2017 were approved.You should contact your congress person .

I just check my local office processing time for I -485, NYC, yesterday they were working with cases filed in June 2016, today it say February 2016!!! how is this possible??? @sandranj 

 

I am October 2016. My I-360 was approved on April 2018.
