Hello,

 

I'm currently filling out form i-130 for my stepchild. After my husband's process I finally was able to change my last name to his last name, I received my new social security card with my married last name. However, I've been lazy and have been dreading going to the DMV/Post office to get a new picture ID to reflect my name change. I plan on submitting my stepchild's i-130 with my passport (with my maiden name), my new social security card (with my married name), and my birth certificate.

 

Does anyone think this will be an issue?

hi

 

you don't need all that,

 

first of all, never send a copy of your social security card to anyone. what you need is your marriage certificate

 

you need, proof of citizenship and copy of marriage certificate to prove that you are married to stepchild's dad, and a copy of the child's birth certificate and if it's not in English, attach a translation into English of said copy. so that your husband can prove that he's the child's father

 

the only proof of name change that you need is your marriage certificate

 

the i130 is to prove and establish relationship between the petitioner and the beneficiary. you have to prove that you are married to the child's father, and that indeed he is the child's father.

 

marriage certificate is proof enough of your last name change

Thank you! I opted out of getting an immigration attorney after reading on here that everyone usually does their paperwork themselves... will save me over $3,000 too! I'm really nervous I'm going to forget to put something in the packet and they'll deny it... If I do forget to include something like a birth certificate will they just send me an RFE? Or will they deny it and charge me another $535 filing fee when I try to refile?

 

I think I overthink everything I do... lol

don't overthink it, if there is something you are missing you'll get an RFE, or if there is something incorrect about the payment, they return the whole package for you to fix the issue and mail it back.

 

read the guide here, ask questions if you need to. that's why we have this forum
