Hello, 

I am in the process of expediting my permission to work (I-765) under an adjustment of status (Green card) 

 

On June 9th, I went to a USCIS office to ask for expedite my permission to work. The officer told me that I would get a notification five days later (at that point I did not get any email confirming my request) Five days later I got the notification in the mail and it said that the request was on hold because I did not have my biometrics done (biometric appointment was for July 25th)

I did my biometrics yesterday morning (07/25), and in the afternoon I called the USCIS to put an expedite request again. Then, I immediately I got an email saying that they put up a request for me but it was on hold because they did not have my biometrics. 

 

Questions:

1. How long does it take for USCIS to get my biometric's results?  (I thought it was automatically)

2. Is there a way to check when the USCIS gets my biometrics?

3. Besides the biometrics, do I need to have my Physical's done before they decide to expedite my case or not? 

4. Should I call the USCIS everyday, to ask if they got my Biometrics? (that is my husband's suggestion ;)

5. Some people contact the local Congressman for help. Have that worked for any of you?

On what grounds is the expedite being made? Financial loss, job offer, or just because you want to work?

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

So you came on a K-1 and are requesting an expedite so soon after filing for AOS (based on this being posted in the K-1 forum)? Sounds like a spousal visa would have been better suited since working right away is important. But that's in the past now...

 

Usually it takes at least a few days for USCIS to see any sort of update. Obviously this depends on the ASC involved too. But it also takes time for them to run the background checks using the biometrics...no idea on the timeline for this, sorry.

You can keep calling to find out when they can see it. However, I'm not sure when a T1 or even T2 would be able to see it in their system.

A medical is not required beforehand...although presumably your K-1 medical would still be valid.

You can contact a congressperson, but all they can do is submit it on your behalf...they don't have an "in" to get it any faster.

I have been under H1B1 work visa for years. I recently got married to a Citizen. So yes, my husband is petitioning for me. 

Thanks for your answer. It makes sense that the USCIS might take some days to run the background check.

Ah, so you are doing AOS from H-1B status, not from a K-1. I requested that a mod move this to the appropriate forum.

1. Biometrics takes about 1-2 business days.

2. You can probably try to get it expedited again today or wait till next Monday.

3. What do you mean by your Physical's? If you are talking about medical exams, then no.

4. I personally wouldn't suggest that. But it won't do any damages to your case and it may help. If you have the time and energy to keep bugging a new representative every day, it's your freedom to do so.

5. You can contact your local congressman for help. But in general, an expedition request doesn't need to be filed via congressman. A lot did reach out to congressman/senator, and most of the time reaching out works.
