What is maximum vacation days while waiting for Lawful Permanent Residency Card?

 Hello Guys,

Is there anybody here knows the maximum

vacation days does a waiting Lawful permanent card holder can stay out of the Country and what are the necessary documents that I need to bring aside from I-751 Notice of Action that will be expired 2 months from now and an expired Conditional Green Card bearing my Maiden surname.

I am actually waiting and in the process of getting my LPR WITH MY MARRIED name on it  this year or probably early next year.I will be traveling this October till November together with my 30 months old son who is a naturalized US citizen.A friend.Hope you can help with my questions.

There is no statutory maximum, but one must retain their permanent residence within the US. For travel over 6 months, they may question it. For trips over 12 months, there is a legal presumption of having abandoned permanent residency.

A vacation trip from Oct. to Nov. very likely won't raise any flags/concerns.

Assuming the 18 month extension letter doesn't arrive soon (they say they are sending them but idk anyone that got the new letter yet), you should get an I-551 stamp in your passport via an Infopass appointment. This will act as a green card for 1 year, so you can re-enter via that. Carry a copy of the marriage certificate as well for evidence of the name change.

If the other legal parent is not travelling with you, I would suggest getting a notarized letter of consent from him/her for the child to travel.  

It is not a requirement to leave the US with one, however, depending on the country you are travelling to they may ask to see it upon entry when the child is accompanied by only one parent.

Geowrian,thank you for your quick reply.I have not yet receive any letter saying the 18 months extension.Do you have any idea how to get the I-551 stamp?All I know is that I need to renew my I-751 NOA before I leave on October.

Like I said, it all depends on the country---some country's border officials ask for it, some don't.  Safer to have it, imo.

US Dept. of Homeland Security suggests it mostly due to the rise of instances in parent-child abductions in custody cases, child trafficking, etc.  ---having the letter can make things easier for you at the border if it's asked for.  Again, the US does not require it upon exit, but strongly suggests it upon entry to another country:

 

"Adults traveling with children should also be aware that, while the U.S. does not require this documentation, other countries may have a requirement and failure to produce notarized permission letters and/or birth certificates could result in travelers being refused entry (Canada has very strict requirements in this regard)."

Schedule an infopass appointment to get an I-551 stamp.

There is no renewal of an I-751 NOA. Either you need the 18 month letter or you can get the stamp.

As stated above schedule a infopass.  If you cant' get an appointment then do a walk in and wait.
