hi, i am divorced with my wife we have child together, its been long time she disapeard with our kid that i raised for 15 months, she was trying to get him adopted by her new boyfriend she met while i was home raising our kid. my question are ; i dont know if she filed the taxes jointly, i am not able to knoe i lost my ss card and gren card conditinal and they told me till i get my new green card removal of conditions, so i dont know hoe to get the joint taxes documents in case they ask for. second birth certificate of our son she said she changed his name and also divorce decree says dissoulution of marraige. ps ; i applied to remove conditions last year.

1. If you lost your social security card you can go to the social security administration and request another one. I am not sure if that is applicable in this case (like if it was removed from you), but if you simply lost it, you should be able to obtain another one.

 

2. Do you know his social security number? If so, you should be able to order a copy of his birth certificate. Do you have a copy of his original birth certificate? That would be helpful.

 

3. Do you have a copy of your divorce decree? 

 

4. You might need a lawyer.

hi jaquelly, i already applied for removing of condition, a attorney at an association handling my case and helping me, i may need a stamps on my pasport cuz my extension letter expering. i have his birth recod hospital document me and m ex wife as parents and i can get his birth certificate without his SSN. i already sent it in to request one, the thing is i think she changed my son family name. i do have a copy divorce decree it says dissolytion of marraige but they told me it may not be the right one.

thankyou nitasman or the answer. are you sure he can't be adopted without my permission, because i havnt received any document, maybe the court gave her rights cuz she hasent served me and she got divorce and she has my son, its been more than 2 years havent seen him she vanished cant know where they are.

Correct. Your son cannot be adopted by another person as long as you are the biological father and you are ALIVE. Your (ex)-spouse needs your explicit consent in order to go ahead with adoption and granting legal guardianship to another man who is not the father.

Also, the court will not pursue a case with her details alone. You would have received a summons to attend a hearing.

 

Unless she told them that you were deceased....or she has no clue where you are.....or some lie that you left her (who knows?)

 

Your attorney should track her down but he may charge extra for services of that nature as it would involve hiring a private investigator, etc.

thank you amadia, i received summons long time ago but couldnt go and thats how she got divorce but i dont know about our son what rights she got. i dont have attorney i have no finances i lost my ss card and green card and i am waiting for the removal of condition so i can work, i have been through a hell. hope i can see him again, its not fair.

Firstly, learn to speak English. This might be the kwa, but at least show a modicum of respect. It will also help you dealing with the bureaucrats.

 

Secondly, have your attorney file in court for a paternity test, if you haven't already. This will help a lot, because people engaging in marriage fraud don't generally have children with their spouse.

 

Thirdly, have your lawyer get on top of what has and hasn't been filed in the relevant court(s).

  1. The OP's English fluency is clearly lacking, not just in the first post but the subsequent attack/rant. While there is nothing wrong with that in itself, it does present challenges in communicating on topics such as immigration where terminology and specifics are crucial.
  2. It is against the VJ ToS to launch personal attacks:

There are ways to do an adoption in which you might not have received paperwork, like via a newspaper notice if they claimed to not know your address.

 

Are you paying child support?  If so, the child hasn't been adopted. 

 

What you really need for this issue is a lawyer, firstly to establish a custody order and secondly to figure out what happened regarding name changes or adoption.
