CR1 / I-130 Filing Location

Hello,

 

I have a question about lockbox filing location. Me and my wife currently live Overseas (Japan). I looked up the correct lockbox, however, I am currently in the U.S. and will be sending the application from the U.S. I often travel to and from Japan (1-2 times a year). Currently I have my mailing address as my Parents physical address in the U.S., but my living address in Japan.... (I live in Japan but visit the U.S. often)

 

Would it be easier to have my mailing address via Japan or U.S.? Does this affect processing times?

It won't affect processing times...just mailing times. If you live in Japan then I would l list that as your residence/physical address. Where asked for a mailing address, you can list any address where you will receive the mail. If that includes your parents' address and you want to use that, then that's fine.

Your question does not seem to be about the lockbox filing location.  Otherwise, your mailing address is what it is and so is your residence address.  File accordingly.

U.S. Embassy in Japan doesn't offer DCF (Direct Consulate Filing) for the immigrant visa?   If they did you could have filed everything there with the USCIS office at the embassy .. been done in about 60 days.   But I see you are now back in the States.

File at the Chicago or Phoenix Lockbox, depending on where you live and whether your relative is also concurrently filing Form I-485, Application to Register Permanent Residence or Adjust Status. For a complete list of addresses, visit our Direct Filing Addresses for Form I-130 webpage.

If you reside outside of the United States where USCIS has an international office, you may file at the USCIS Chicago Lockbox facility. If you are a U.S. citizen age 21 years or older and are filing for a spouse or unmarried child under the age of 21 or a parent, you may also file at the USCIS international office in the country in which you reside. 

 

If you are a U.S. citizen and you reside outside of the United States where USCIS does not have an international office, you may file for an immediate relative at the U.S. Embassy or consulate having jurisdiction over the area where you live only if:

• Exceptional circumstances (PDF, 61 KB) exist, and
• The USCIS field office director with jurisdiction over that location determines that the embassy or consulate may accept and adjudicate the case.
